Bilstein did replace both of them under warranty but the process was not easy or quick.

5 years use of the shocks with 4k miles per year
parts will fail and shocks are typically ones to do so. The OEM shocks well those seem to be a different story. The 5160s I had were from the TRD clearance sale from the FJ, manufacturer date was probably 2007-12 maybe. I ended up with 5-6 years of on road use with around 70k miles.
