Off Topic Advice Please

My daily driver is now my 4Runner after my 2018 Lexus was totaled. Kid was texting collided with me...rear destroyed. Protected me took the hit. So here is my question. He was insured.

How does that work to compensate me for the $17K already paid on the Lexus if they just pay it off?

He was cited for speed. His Prius was crushed.

Insurance pays you the value of the Lexus, not the loan balance. Plus any injuries. If you were hit that badly, a doctor visit is in order.

Do your homework, research replacement costs for same mileage/model etc and have it in writing. Insurance will most likely try and lowball you, don't take the first offer unless you think it's actually good. Show them your research for a proper payment.

Do make sure you do not have medical issues that crop up. Neck pain is not always on day one. Talk of that may push them to give you a proper replacement amount. They are not in the business of fairness.

Remember that the car payment is separate from the bodily injury payment. You can settle the car payment, and not accept their payment for bodily injury until you are healed. I think it's up to a year from the accident.

You already got good advice on the car reimbursement part. Whatever price they give you should include a list of comps on how they came up with that price. If not, ask for it, or do it yourself and negotiate.
