I think situations like these are always more complicated than they should be.

Toyota is definitely giving me more money than they are required to by the SC Lemon Law and I am beyond thankful for that, but I'm still losing a significant amount of money considering I've only had the car for almost 8 months. I can live with it because I'm ready to move on!

The dealer I am working with is a solid guy and I have no doubt I will walk away happy.

How are you losing money? If it is a lemon buyback, they should refund every dollar you’ve spent on the car, any money down, payments you’ve made, tax, tag and title, minus any modifications you made and maintenance costs. Are they charging you for miles driven?

So under SC law, they take the purchase price of the vehicle before TTL then deduct what you owe, then deduct mileage, and add taxes, interest, closing fee and payments made back into it.

You would think this would add right back up to everything you've put into it, but it does not. I've done and redone the math.

Then there are the items that I can't get paid back for. I will lose just under $3k (maybe not much to some people, but it's a lot to me), but it could have been much worse than that so I'm thankful that they paid me back for a few things and helped me out on the mileage deduction.

Just trying to stay positive and move on at this point!

Just catching this thread but glad the dealer is working with you! Hopefully getting the Pro ends up as a wash or to the good in the end.

I have noticed similar road behavior with my TRD ORP but mine is so intermittent and mild that I have not addressed with the dealer. Seems to be only in the morning at 65-70 mph on the freeway and then it goes away. I drove it to up to Bristol last weekend and it never showed any of the symptoms. Then yesterday AM it happened but went away after a few miles of driving. I thought I might just have a rock in the treads or maybe the road conditions. Strange and something to keep an eye on.

I hope it all works out for the best. After all the mods you have gone through that would be frustrating to say the least. I'd definitely remove what parts you think you can reuse on the new Runner.

Not to nitpick, but since they are not buying the car back under any lemon law, they can do whatever they want. They can give you any amount that you agree to and they can sell you the new car at cost (not invoice) minus rebates and a spiff from Toyota.

If you feel that you're not treated fairly, then call a lemon lawyer.

Without getting too personal, if you feel as though you are not being compensated appropriately you can continue to accrue time towards a lemon law claim. Their offer to you is a starting point and not your only option. What offer you do receive should meet or exceed what a lemon law claim would yield. If not, accepting their initial offer would feel hasty.

Toyotas process for buyback/lemon law begins with setting up arbitration with NCDS, a company that Toyota pays directly. As you might guess, the vast majority of these hearings favor Toyota.
Once you lose the first hearing you can then file a state lemon law case which begins with a true unbiased third party arbitrator. You can retain legal council in either of the arbitrations or opt to present your case yourself. The NCDS arbitration has the option of a "documents only" hearing, which is what you should choose unless you have retained an attorney. Reason why the documents only for the NCDS arbitration is to speed along losing so you can file a state lemon law case.
Last resort if you lose the state arbitration is to sue.

Getting an attorney involved will drag the case out, but its not a bad idea if your case is questionable.

Majority of the states deduct for mileage, but you can get hosed on this if you havent gotten to the state lemon law filing yet. The deduction starts with the mileage the problem FIRST occured... so if the problem started at 800 miles but has gone in till 10,000 miles the deduction will is be calculated at 800 miles NOT 10,000.
Dealer installed accessories will be refunded by law... ones you added on your own CAN BE refunded but without an attorney the chances are slim for those.

Surprised that Toyota is opting to buyback without arbitration, you can pull up lots of Toyota cases and they never back down.

Yes, this was due to the same steering vibration. Both of the ORP were exhibiting the issue really badly and the first 2 Pros had it but not as severe as the ORP. The 3rd Pro was hardly noticeable and the 4th Pro was perfect and now on hold for me.

Do take into account that I’m currently hypersensitive to this vibration and the 3rd Pro I drove would have worked fine for me, but it was one of those, “This is my car!” moments when I drove the 4th one.

Hoping to drive it home by September 7th.

Just waiting to surrender my ORP and get my repurchase check, which everything will be pushed back a day or two because of Labor Day.

Maybe I get lucky and Toyota starts pushing better financing for ‘19 Pros in September! That’s a pipe dream though.

I imagine lawyering up sucks, but you can always call a lawyer who is a professional in lemon laws AND in your county to get his/ her opinion. Don't ask any lawyer that does not practice in this narrow field. Use some of the verbiage for step two below.

Post your story to the Better Business Bureau using the specific dealership you are working with. Name the people you are interacting with by name. Part of the form you fill out online will be what they can do to make it better. If it were me, I would ask them to pay me in full (including that $3k), compensate me for the rental and to give you an extended premium warranty on the replacement for peace of mind on your new 4Runner. I bet it will take you 15 minutes- pretty good pay rate to get all that for 15 minutes. I did this with my 2nd gen ages ago and was taken care of almost immediately. If you can write decently, keep it short and reasonable without underselling the massive pain this has been, then I suspect they will be very compliant to keep your business.

5/6 cars you drove had steering vibration? That doesn't sound good. The ORPs were worse?

With those numbers I'm surprised they can even sell this model.

One would think that with the number of complaints on this issue Toyota would have a handle on it by now.

Wonder did OP raise this issue with the NHTSA?

I'm looking to get a '20 ORP hope this is totally resolved by then.

Anyone can file a complaint with NHTSA on-line.

NHTSA will not get you a replacement car. Over time, with enough complaints, NHTSA can force a manufacture to make some changes if warranted. IMO the OP is far too into this process to do anything except move forward as she is. Best of luck to her.

I agree and I’m really surprised that the issue still exists, especially as common as it appears to be. I’ve had two 4Runners and it’s been present on both. Currently I get the wobble on certain surfaces and I don’t drive above 60mph often so I accept it. But it will very likely be a factor when shopping for my next vehicle. And I worry a bit about resale.
