I'd suggest getting a good lawyer sooner rather than later. You just bought a brand new car, you should still be driving a brand new car that has the same value as your car. If you car doesn't get totaled out, you should get paid out for diminished value

Just keep in mind, you do not have to accept what his insurance co. offers. Also remember you will need a rental car while your t4r is being repaired, and of course it is more convenient to drop it off on a Friday so you will be driving the rental all weekend before they even touch it on Monday. How will you be getting from the repair shop to the car rental place? Will you need a taxi?
These are things that you can ponder while sitting in the insurance agent's office, and then you can still get up and walk out.
Remember, the last thing in the world the agent wants is for you to hire a lawyer.

Since the car is less than 5 years old, Indiana requires use of factory parts.

Also, for the diminished value claim, you might need a certified quote, which costs money, depending on the insurance company you are dealing with. The Company my girlfriend used was Appraisal Group of America. Cost $200 for the certified diminished value quote.

For starters don't sign ANYTHING from the perps insurance company. You were T-boned and that is a serious accident that can cause serious personal injury. You may not feel it now but you may in a few days or weeks. Pay attention to any new aches and pains and document them. See your doc as well to start a medical history.
I would also insist Toyota do the repairs if you end up going that route as they will have the parts, expertise with 4runner, and know how to properly check all frame tolerances and specs for "hidden" damage.
Be a hardass on this and get a lawyer if necessary. Accident / injury lawyers won't cost you a dime.

I was already feeling it last night. Neck, shoulder, and wrist are sore and I've had a mild headache ever since. Luckily, I already had a dr appt scheduled for Tuesday so I'm starting that paper trail. I'm going to get an estimate before the adjust has a chance to look at it. My Toyota dealer doesn't have a body shop but they partner with the local GMC dealer on all of their body work and they do an excellent job. I'm just going to push for a new 4Runner...I shouldn't have to settle for a repair...the damage is more extensive than the picture shows.

Time to lawyer up. We had a similar situation with my wife being t-boned and the Lawyer was a lifesaver when it came to handling the insurance companies.

Preliminary repair estimate is at $7200. That's providing it just needs alignment and nothing is bent underneath.

The other guys insurance is Progressive and no way they'll total it even if they end up giving me diminished value compensation.

But, damn I had a brand new 4Runner and should have a new 4Runner after this is over.

I'm not too excited because the body guy said they'd have to remove quit a bit of the interior to make the repairs due to the door rail damages...I have no tolerance for rattles and I don't care how good they are, it's never the same!

I would discuss it with your Toyota Dealer and trade it in for a new one and they get to keep the insurance payout.

That looks brutal, obvious besides doors, if the B-pillar is bent, doesn't that compromise the integrity of the vehicle such that it lessens its ability to withstand another large impact? I'm not sure on that part.

What i do know is that if those rocker panels are bent, you're going to have premature rust issues down the road. The rocker panels are several sheets of metal pinch welded together with 1/8"ish gaps between them. Certain whole bits of the vehicle are literally dipped in a primer + paint bath so that paint goes into every crevice and crack possible. The rocker panels is one of those pieces. If the paint is compromised, those pinch welds hold a ton of dirt and moisture. So it may be one of those things that nobody can see and rear its head down the road i.e. premature rust after insurance fix.

There is absolutely 0 way of fixing damaged rocker panels to the quality of straight from the factory. Even if you cut them out and weld in new pieces, you run the risk of trapping moisture in the welds which will rust from inside out. Nobody can say for sure what the likelihood of this is, but it's definitely a possibility greater than 0.

keep up with it man. I had a 2019 trd offroad taco with 2k on it. ford edge hit me from behind while I was at a deadstop doing atleast 50mph. 18k+ in damage. frame needed to be replaced along with other items. im still dealing with the other guys insurance. 2 weeks later my (usaa)insurance company called to tell me my truck was totaled and go look for a new vehicle. you have good coverage as far as under/un insured, pip?

jesus yeaa good luck. other guys insurance that hit me has progressive and they were getting pissy about me going to the dr to have my back checked out. not sure what they had to say when my insurance totaled it out but im sure they weren't happy
