For the amount of people driving around with no headlights, DRL only, or high beams on all the time, I really doubt you're going to get pulled over for non-DOT approved headlights provided they are functioning without strobing, bouncing all over the road, or lighting up the space ships with their nightly anal probes. Cops have better things to worry about than to determine whether your headlights are street legal. Running around with 20 LED light bars on might get you pulled over, replacing your overpriced short lived halogen with a brighter better alternative will in all likeliness not.
The only DOT legal lights left on my truck are the 3 brake lights, everything else has been replaced with something non-DOT approved.
I did get pulled over once for lighting, my license plate lights were el-cheap-o brand and started strobing intermittently. Being they are on the rear license plate I never knew. Not even a written warning, just a let you know you have a problem so you can replace them.
The ONLY way I could see this being an issue is if you reside in a state or county which requires annual inspections, and your selected inspector is a (big phallic symbol). In which case you take your vehicle to another shop and pay them the fee to pass you or replace the lights and go back to (big phallic symbol) who's robbing you anyway.
