In my opinion, the fact that they have to fix dents and re-paint the entire tail gate does not support this statement.

Been there! Unfortunately you will have a difficult time getting reimbursed money from the dealer for things like your lost time, your inconvenience, depreciation to the vehicle, your sheer frustration, etc. What the dealer IS obligated to do is repair everything they have done to your vehicle...
