The windshield tint is illegal, but there is no way for them to verify it is tinted if it is done by a good shop. In order to measure the tint they clip a meter on either side of the window that measures the tint. Since this is not possible on the windshield, they cant see whether it is tinted...

I cut out about half of mine and zip tied it up. My buddy has an xterra and he used a heat gun to melt the lining and push it up higher. But if you can see where it is rubbing than you should know what needs to be trimmed.
