Accident advice

My momma was rear ended on Saturday in her jeep compass by another jeep. The guy left the scene and came back before the cops got there. He hit her hard enough to leave an imprint of his license plate on her bumper. Momma has a sore neck and a bruised sternum from hitting the wheel.

I was hoping the insurance would total it so she could get a Toyota but they said it's going to cost 9k in repairs. My biggest concern was the frame being bent and they said it is. So can the frame be unbent?

I know I got screwed over before after an accident and I don't want the same to happen to my momma.

how much is the compass worth? usually frame damage is a solid point of reference to writing a vehicle off
 
strange that the guy left but came back. I wonder what he had in the Jeep he did not want the cops to find or if it was the same guy that came back that hit her.

I have always heard that insurance companies don't repair frames. You may want to question them about that.
 
Is a Compass body-on-frame? I thought it would be a unibody. It will never be "right" if there was that much $ of damage. Any pics?

He said he had to get his daughter but she looked like a middle schooler my mom said and he didn't go the direction of any schools.

I thought all vehicles had a "frame". Stupid me didn't get pictures, but the back passenger door is tweaked and doesn't close completely and the base and both sides of the cargo area are pushed forward and up.
 
Most vehicles today have a unibody "framework" made up of interior body sheet metal. Very few modern vehicles have a body-on-frame construction except pickup trucks and some SUVs, like the T4R.

It is very difficult and takes a good shop to get a unibody back to original. There are alot of shops out there but not all are good at it.

anyway, frame damage usually means a write off as a total. most of the time frame damage is not worth fixing ESPECIALLY if its a unibody, as a lot of the jeeps are. Not sure if the compass does ( not a jeep guy, so idk) I would just haggle with the insurance company to pay up for a new car and pay the medical bills for your mother. I hope it works out in your favor, & blessings to your mom, hope she feels better.
 
You can make them play ball. Several years ago, my wife was t-boned by someone who ran a red light. The car was took about 9k in damage.

The other driver's insurance company was insisting that we fix the car. I convinced them to play ball my way by reminding them that my wife was not at fault and that it was their customer that hit her. I also talked to a sales manager at a car dealership to find out how much of a loss I would take if I were to try to repair and then sell the car.

I then went back to the insurance company and told them that I would fix the car, but I wanted a check to cover the diminished value of the car. The insurance company then flip-flopped and decided to total the car which is what I wanted in the first place.

I told them that I was fine with totaling the car, but that I wanted to keep it and sell it for scrap myself. They balked again. I reminded them again that I not only did I still hold the title, but I was in control since it was their customer that hit my wife. They backed off and agreed, but with one stipulation. They wanted to get their own scrap metal quote and take that off of the total that they would pay for the car. I agreed.

They took off $2500 for the quote they got which was fine because I had already been offered $6500 cash for it by someone else. I also told them that my wife had to miss a few days of work until we could come up with alternate wheels and wanted compensation for that. They agreed to compensate us.

All said and done, I managed to get enough money to almost pay off the car - within 1k, which was good because my wife was upside down on it anyway (she bought it before we got married).


Moral of the story: Don't let the insurance company push you around.

So I KBB'd the value and came up with

Trade in/very good condition $5,951
Private party/very good condition $7,206

Its a 2007 manual with 91k miles, its in great condition. They owe $14k on the loan.

I dont understand why the repairs are more than what the car is worth. Im thinking they are better off taking the check and selling/parting out the jeep.
 
Unless the insurance company pays off the $14k they may have a problem. Whoever the loan is with is using the car as collateral. They may want the car repaired. The insurance company may make the check out to your mother and the lean holder.

If all they will give is $7k to total it, that will leave another $7k owed on the loan with no collateral.

Your mother may be forced to have the car repaired because of the loan.

wow....terrible resale value on that thing. its only worth $6k, and they still owe $14k on it? OUCH.

should have bought a 4runner...


as said above, theres going to be issues with the bank.

This is refferred to as being "upside down" as far as the vehicle worth/amount owing is concerned, and not a great spot to be in.

If the payout would be only $7K and the amount owing is $14K, the lien holder would take the $7K and your momma would still owe $7K, and she'd have no vehicle. In this scenario, she'd be better off having it repaired so she at least has it to drive going forward.

They owe the 14k cause the rolled over another auto loan into the jeep loan…..I keep telling her to get a 4Runner or at least a Toyota!!
 
UPDATE……

So both insurance companies called it a total loss. They valued it at $10.5k and it went towards the loan. The guy admitted he was at fault.

The best news is I get to find her a new Runner :cheer2: but I only have a budget of $10k and it has to be through a dealer. Found a super nice 05 Limited. 100,233 miles, leather, JBL, sunroof, drove great, H4 & L4 worked, service records still in it with work done at Toyota, but it was $15.9k, I considered trading Gregs for it hehe.

My dad is butt hurt cause he doesn't get to help haha. So said she trusts me to find her something really good, so no pressure there.
