ATF Hold???? What Gives?

Today I went to my FFL to pick up a lower receiver for my current AR project (AR-15 in 7.62x39) and for the first time in my life I was told I have a 5 day hold.

WHAT!!

Here is what I know, I had top secret security clearance in the Army (because I was the assistant Armor), after my ETS I was a police office (with two different departments) for a few years. I have bought dozens of guns at retailers in the last 15 years (including 2 in the last 90 days). I have a legal concealed carry permit (renewed in 2015).I have had my on gun trust established since 2012 and have only ever had a couple speeding tickets in my life.

So what on earth make the ATF restrict a legal US citizen from buying a gun without having to provide any explanation?

I understand its just a hold, and in 5 days (unless told otherwise) I can pick the receiver up.... But, it kills me knowing they can stop me from legally purchasing a firearm at will without any known grounds or explanation.

Anyone else ever have this happen?

Did you try calling the ATF and asking? Cali we get holds no matter what. I had a extra 7 day hold. The shop didnt know why. The agent I called was super nice. Told me because I have 2 address and have used both. They needed to see that both are legit addresses to make a long story short. They as so backed up with paper work something that would be done in a day takes longer.
This election laws for sure are going to change if one candidate wins sales are the highest ever.

not a big deal, happens every now and then. May be as simple as they are backed up with backgrounds to clear and you're simply waiting your turn.

I know the systems has gone down a few times in the last week alone. I wonder if that has something to do with it. Either way, it still makes me upset that I would have any sort of restriction.

On a side note, the Ruger rep was at the dealer when I was there and he claims the reason all these $425-$499 US made AR-15s are being sold all over the place is because manufacturers are sitting on stockpiles of these things and may very soon not be able to sell them. I have 2 local friends that bought a DPMS AR-15 5.56/.223 for $477 out the door at Rural King yesterday and today. I cannot even build them that cheap with import parts.

Also, I scored a cool Ruger clear take-down counter mat.

it could be that someone else with your same name has a problem. or with a very similar SS#, or license number.

or, that there was a typo on someone's info, and it creates a conflict, thus the flag. many different ways for it to get flagged. in fact, its surprising more aren't delayed because of how convoluted the system is.

I had a non-violent bullshit misdemeanor charge when I was younger. I used to get flagged EVERY time because of it. I was told because the departments don't share info. so it showed the charge, but no other info. they had to investigate further. I filed for a NICS fast pass specifically because of the hassle.

I used that a few times. it seems they have cleared things up, as I have not needed it the last few.

As a Gulf War 1 vet, way so long ago my senior NCO said, what ever job you get buy 1 box of ammo per pay check. Never thought those were true words of wisdom. In california we have a ballot measure to do background checks and to ban online sales of ALL ammo (you know for all those felons who cant own guns to stop them). Im sure it will pass.
So I pass those words of wisdom to others, min wadge or millionaire buy a box every paycheck. I never thought it would happen but its going to.

You know a easy way to speed things up like that is to have a Living Trust right. I have been looking into this for some time and doing my home work on it. We can talk off line more about it. Shoot me a PM.

I've gotten a hold every time. Having no immediate need for the firearm didn't dissuade me from following through or bother me. I suppose if I needed an immediate purchase I'd hit up armslist.

You know a easy way to speed things up like that is to have a Living Trust right. I have been looking into this for some time and doing my home work on it. We can talk off line more about it. Shoot me a PM.

Are yo asking me how to do a trust? I just paid an attorney to set mine up. I only mentioned it in my original post because it's another reason I feel I should not have a hold. The trust does not make it easier to get firearms necessarily, it's so I can legally purchase restricted items such as suppressors. It has never been helpful to me in the acquisition of a fire arm.

It's not bad advise at all, back when ammo was cheap and shooting was "fun" I often bought by the cases and would easily go through a case or more in a weekend. Now, I seldom shoot more than a box or two at any given time in order to keep my supply deep.

I did not need it in a hurry, it was only a single component of an AR and not even a firearm. I've never needed to buy a gun in a hurry, I have my own armory and "need" nothing. The issue here is not speed of acquisition, it's simply the fact that my right to legally buy a firearm was restricted without cause or explanation.

I don't want to come a cross as some crazed gun packing, cigarette smoking, mullet sporting, foil hat wearing nut job. I'm not even against background check as a general principle. IMHO, people without proper training should not be allowed to just buy a gun given the fact that according to the FBI 23% of all gun related deaths are ruled an accident. What I don't like about this system is, nobody has to have any cause or permissions to restrict an American citizen from buying a gun.

You are 100% spot on. It doesn't make getting them easy for say it just speeds up the process up once you have to go through the ATF GENERALLY anyhow. They look at it a person is not requesting it for say. It's a trust so how am I going to run a background on a trust? Anyone who goes thought the process to get one and set it up is generally on the up and up anyhow. I mean really is a criminal going to spend thousands of bucks to get the same thing he is going to buy on the streets for cheaper? I have an appt to meet with an Atty just to do this real soon. The way things are going I feel it's going to be the only way to get my hands on Cans anyhow. Keep us posted on it if you would please.

In TX you don't even have to go through an NICS if you have a CHL...

I have a TX CHL but it does not help in Ohio.....It's valid here, but does not help with BG Checks.

You need to spend a little more time talking to attorneys before you pull the trigger. The trust will NOT speed up buying a gun (in states that do not have holding periods mandatory). Fact is, if I go to Cabelas and buy a new 1911 I can be in and out in about 30-40 min. If I try the same thing with a trust, it confuses in store help and in some cases will require an investigation into the trust to release controlled firearms, but at a minimum will require the staff to call their ATF rep for SOP. Furthermore, any items bought under your trust must remain with the trust. So if you die, it all remains part of the trust. A trust is handy if you plan on buying specific regulated items, but for general purchasing, it can be more struggle than its worth.

Side note: It cost about $200 to set up a gun trust legally and it must be notarized. If someone is charging thousands to set up a trust, its because they are willing to dump a ton of money on something they don't understand.

A trust doesn't speed things up like it used to with the new laws regulating it. And protect yourself and make sure it is a "firearms" trust. A little protective verbiage in the documents can go along way to protecting you and your family if you have to use your firearm and the criminal decides to sue you.

In Washington myself and 2 friends went in to purchase pistols. All of us have CPL's and all good clean records, ect. Mine came back good to go got my pistol OTC and was able to walk out. Both my buddies got holds placed. One is retired army and one active duty still. The clerk said it's somewhat common for holds to be placed on military and government employees. He wasn't sure why but it's somewhat normal. Sucks but seems to be the way it is now.
