It's not wire fraud either. Everything is done by wire these days, that does not make every unsatisfactory transaction wire fraud.

Simple theft? Honest question about what it would be categorized as when you pay for a good that is, in the end not provided in a timely manner based upon original agreement so you ask for refund and it is not returned? Aside from poor business what would this be considered?

yes it most certainly is. This is not a single event or a "bad transaction" he knowingly accepted money for goods over the internet from MULTIPLE people. He knowingly provided false shipping details and has dodged all communication. I have seen numerous cases similar to this prosecuted under the guise of Wire Fraud.
In order for this to be a crime you would have to prove intent to deprive. Unfortunately, he is still providing the product, however slow. The lack of communication and lead times turns this into a civil issue, CA statute.

simply done by his own words. He has provided product to some.... and not at all to others. By his own admission he "shipped a rack" last year and it is nowhere to be found.... pretty straight forward. Why would anyone pursue a civil case? it would cost more than the rack is worth.... that is what AHoles like this guy hope for..... by everyone that got screwed calling the local PD and filing a claim it would provide more than enough ammo to nail this POS.... at this point I think that is all anyone can hope for.... their money is gone and they will never see a rack
But I digress.... if you and Delloro stayed at a Holiday Inn Express last night we should certainly follow your legal advise lol

Haha! Yes, call the local PD and let me know if they take a report. I guarantee they will advise that this is a civil matter, trust me!!
Im not trying to argue or debate with you, just provide fact when it comes to the difference between civil and criminal. In all honesty I don't like what this guy is doing either to hard working people. To each their own.

kind of my point when I said "unless you stayed at a holiday Inn" speculation isn't fact nor is it law. I might have been privy to successful prosecution of wire fraud in the past..... or maybe I just stayed at a Holiday Inn Express too :bigok:

Well, I didn't stay at a Holiday Inn last night, so the only logical conclusion is that it must be aggravated class-action wire fraud with special enhancements such as a 100-page pissing thread. And tortious breach of contract. There's probably some emotional distress and third-party intetests in there as well; some people in this thread have no dealings whatsoever with Drabbits, yet their panties have been maliciously, negligently, intentionally, and recklessly wadded. Postal fraud too.

Hi all...I ordered my rack from Alex back in late February or early March of 2016....needless to say it has been a frustrating year and I have experienced every emotion that each of you has mentioned in the latter part of this thread at one point or another. It annoyed me that my ~$800 wasn't in my bank account earning my own interest but rather sitting with Alex this whole time - that was one of my bigger issues with him. All of that being said....I THINK my rack is finally on its way. Either that or there is an 85 lb box of packing peanuts currently in Ft Worth TX destined to my address. I would text Alex daily, sometimes more for updates. At one point he claimed it was ready to go in November but then got held up for some reason and then he needed to use my completed rack to fulfill someone elses order who had been waiting (or so he says) and then he had some family/illness issues and then there was flooding in California and at various times along the way there were a bevvy of issues with his powder coater. So believe me...I've been through the ringer with this experience. I am usually one of the more skeptical people on the planet and quick to label someone a fraud/scammer but in this case, at least with regards to my order I don't believe that Alex is. I think he is an awful communicator and perhaps a little/lot disorganized on his end. It's possible too that he was overwhelmed and unprepared initially for the business he would come into which is a shame for those of us who had to endure this and also a shame for him as it seems was he more organized, prepared and efficient he could have been cleaning house by producing this rack.
Dsepite all of that, I will follow up this post hopefully once the rack is in hand, provide a review of how it looks from everything from the shipping materials to the rack itself and then when I get a chance, now that its back to single digits in Philly, I will install it and provide photos.
I think he at least did the right thing in coming back into this thread and posting the update that he did and informing new people that he is not taking orders.
