I just got my 98 4runner in the summer time so this is my first winter with it, everytime i start the car in the morning is almost seems like the brakes are stuck to the wheels cause i have to accelerate quite a bit to make it go, when it does finally take up it jerks and makes a loud noise. Is this a transmission problem? Help?

Nope, more than likely your emergency brake is stuck due to either leaking inner axle seals or the bellcrank(s) are rusted.

Get under the truck and take look a the emergency brake line.

The e brake is cable operated. It's a silver cable running along the back of your differential, it has a bracket and bolt bolting it to the differential actually. You really can't miss it.
Is yours an automatic? If so, don't use the e brake. Park on a flat surface and you don't need it.

I actually don't use the e brake I park on my driveway which is flat. and once I locate the line what do I have to do to fix it?

This isn't going to help your issue but...
USE the parking/E brake every time you park. It will keep the rear brakes adjusted.
AND I have seen vehicles roll away like they are in neutral. This is because one rear wheel is on ice and the other on dry ground (Auto trans in park). This is because the rear diff is open which will allow the wheels to spin in opposite directions even when the trans is in park.
