I didn't have collision on a car that old so looks like unless my insurance pays out (I think they'll pay but the idea that they might not has me scared) I get to fix my car out of pocket, get into a long drawn out court case with this moron, and I'll probaby get $5/month for 100 years or something similiar. I DID get the tag right. The guy never registered the truck so he wouldn't have to pay sales tax on it. He put his old tags on the truck so the when the cops ran the tag it showed a different vehicle. The cops went to his house looking for him friday, and he turned himself in on saturday (wouldn't exactly say he did it by choice). The fact that he openly admitted to doing it on purpose has made me rethink my "stupid kid" excuse I made for him. I really thought it might have been accidental (still not ok, but not completely on purpose). In the meantime I'm going to be driving the jeep to work. I don't mind that but with gas as high as it is I'd sure like to have my car back..... I drove the 4runner today but my wife can't drive the jeep so I'm gonna have to give the nice ride back to her (and man was it nice driving it!) Oh, and I'm also waiting for my insurance rates to double or them to cancel me altogether since I was involved in an accident caused by "road rage". I told them I flipped the guy off, and while that's not illegal, the insurance companies can still use that as a "risk" I took that lead to an accident. They don't have to have a chance to cancel you/raise your rates now so I'll wait for that one too. All this on my vacation I took to help the wife with the new baby after her c-section. Next year I'll just not take my vacation.......

aggressive/offensive driving
In many states (like MA) they have laws against aggressive and/or offensive drivers. You flip someone off once and you get a warning. You do it again and it's $50 plus 1 point on your license. 3rd time, and you get $150 plus 1 point. 6 points and it's back to traffic school.
Take some advice, especially since you have kids... Relax about the way other people drive. Drive defensively and let those other aggressive idiot drivers have a faster path to their grave. I used to be a lot more aggressive, but my kids became much more important that preventing some a**hole pass me or cut in front of me, or flipping the jerk the finger because of what they did. Remember kids have a way of repeating what you do, and what you say at the worst moments.

Talk to a Lawyer and have them work with you and the prosecutor, since they work deals in most cases they can make it part of the bargin that you get your car paid for or he does time/Felony. Even this dirt bag has a Mother/Father that will borrow money to keep their kid from doing hard time. That way you get paid and he still has a record and gets some punishment. Good luck

Thanks for candidly sharing your action and mis-fortune. This is as valuable as any cool mod. idea.
Getting mad, vengence, and fighting are ego things that males seem to have. It's an intrinsic quality that maybe was once useful for survival and needs to be controlled at a higher level of thought process. My wife is often the source of my higher level of thought process and needs to remind me when I want to go psycho because of someone.
Like swatting flies, there's a million jerks out there and only one of you.

I had a hit and run once in front of a 7-11. They kid (14) got out of his mom's grand cherokee he stole for the night and was acting cool, I had a whitness who even saw him back into me. I went inside the 7-11 to get a pen, turn around and the little s*** flipped a bitch and boned out. I ran to my TL and put all 270 horses to try and catch his ass, he was already out of sight. The cops came, didn't get any information from the kid. So I'm driving down a street a few nights later with some friends looking for a green grand cherokee, bingo! Found the car on the street in front of an apartment building and found some lady outside who told me who's car it was, went to the door and raised some hell. The cops came and took some photos of the other cars damage, came back the next day and went to talk to the mom. Well, got his ass busted and my damage payed for plus some. Hope you have good luck with this.
I don't know how it is in other states but in CO if you are in fear of your life you can defend yourself with a concealed weapon and be immune of any civil lawsuit (as long as you are in the right to use force to defend yourself), says it right there in the law itself.wm69 said:

Now in this scenario also they have two choices; 1) they could continue to come after you (in which point you would need to determine by their body language, facial expressions, etc. how to react with your weapon. This is the grey area, I hope it would never come to this but you never know when drugs are involved. Me, I'd give a verbal warning to stop where they are and get back in the truck, if disobeyed, then I'd start shooting.) or 2) Probably the more likely of the two choices, they would just see the weapon and get back in the truck and leave.
The most likely outcome of the situation is them getting back in the truck and leaving after you pull your weapon because you are in control of the situation. BY HAVING THE GUN, YOU HAVE AVERTED VIOLENCE. I'm not saying you have to start shooting by having a concealed weapon, but a handgun sure does put a huge exclamation point on, "Back the F*CK UP!!"
People in this country forget that the right to bear arms is a constitutional right. Its the god damn second amendment; right behind free speech for christ sakes!! And hardly anyone in this country uses it!! Am I saying everyone go out, buy a gun, and start shooting people when they piss you off??? No, of course not. But to have one in a situation similar to the one above, it could save your life.

You can also use deadly force in our state (VA) if you honestly believe (and can articulate in court) that you feared for your life or that of a loved one (child, spouse, etc.) who is with you.
Our concealed-carry law has been in effect for ten years now, and has worked quite well. Nice to make the bad guys quake in fear over which of their would-be victims might be armed!

What is "legal" doesn't always hold up in civil court, and even if it does hold up you still have to pay to defend yourself. Anyhow, to finish off this thread, my insurance (USAA) covered my car under uninsured motorist. They initially offered me $1600 for the car minus the $500 salvage value (I wanted to keep the car and fix it) minus my $200 deductible ='s $900. I pitched a fit and sent them every maint record for the last 5 years/120K miles and told them that the car had been meticulously maintained since new and had no mechanical problems (this is where keeping your service receipts helps) and they upped the offer by about $1200. I ended up getting about $2100 from the insurance company, kept the car, got a new bumper and trunk lid for $500 out of the junkyard (already the right color!), got tail lights off ebay for $50, got my shadetree (retired gm dealership body guy) to bondo the left corner and get everything installed and smoothed up for $700, and that left me enough to buy a new set of Michelin X radials (84K out of the last set I had) and get a new muffler.
The kid plead guilty to criminal mischief and get a year probation and $1000 fine and was ordered to pay USAA back what they lost and also pay my deductible on my uninsured motorist coverage. USAA later refunded my deductible after they collected from the guy so I actually got my deductible back twice.
Car still runs like a top. The left rear is painted with rustoleum (didn't see any point in making it pretty when it's got 225K on it now and dents on the hood, drivers door, and both front fenders (and oxidized paint all over). It doesn't look great but looks ok from a distance and still gets me from point A to point B. My body guy could have made it look great but I told him to do it as cheaply as possible and since the salvage yard trunk lid and bumper were already the right color he just straightened it out and primed the area in front of the left taillight. It looks better than I thought it would.
Well let me be the first to congratulate you on your victory over insurance companies; not an easy thing to do. I'm also glad that no one got hurt and that this kid got what was coming to him.
I don't know if I would've been able to keep my cool like you did. I'm sure I would've done something to make it worse, I'm a bit of a hothead when it comes to driving (I'm 23). I admire you for staying composed through the whole thing and look what it got you!!
