What is wrong with people?!

So someone decided that they would try and pull a hit and run on my 4runner in my covered parking spot. Long story short, no witnesses, but I found the car that did it…the person lives across the parking lot from me in the same apartment complex, still has my paint on the car, expired inspection, and according to my insurance company has no insurance and not responding to them trying to get in touch with her.

I had to go ahead and make a claim against my insurance for them to pay me and that gives them the right to go after her. So now everything is being turned into the subrogation department of my insurance, but that is not enough for me. I tried calling the police about her having no insurance and they won’t do anything unless they catch her on the street. I tried getting the apartment complex to have her vehicle towed for no inspection, but they can’t single her out due to fair housing act or something…all they can do is call the tow company to make a sweep of vehicles and if the car is not here then she gets away with it. I need to figure out how to get this person and her car off the road before she injures someone with no insurance…oh, did I mention that this happened between midnight and 8 A.M. when I found the 4runner damaged? Which means it was very likely this person was drinking and driving with NO insurance. What else am I not thinking of that I can do?

There is more damage and paint on her vehicle but I don't want to bombard you guys with the 50+ pics I have. You can see how the paint from the fender flare rubbed off and mixed with the white paint of the car to make a teal green, and it’s obviously on both vehicles. Also I have pics that show the car rubbed up against a larger tire, like my 32’s that were freshly dressed so it left obvious tire marks on the car. I measured all the damage and heights on both vehicles and they all match up along with the side wall tread pattern on her car that matches up to the ones left on my tire when she ran over it. I have called the city police, texas DMV and the Texas Dept of Insurance…and nobody will do anything, freaking amazing.

Document it and file in small claims court. Fees are minimal and this will give you a chance to get her into the legal system. Small claim allows up to $10,000 in awards. I'd avoid the insurance company as your rates will now go up. If they do, add it to the complaint.

It was an option, but I opted for the Insurance company to pursue her since the outcomes will likely be the same....she wont pay either way. That and I may be moving to another state in a month or so and I don't want to deal with driving back and forth for court. That part is done, I am trying to figure out how to get the b*tch off the road and get her car impounded, suspended license, fees, etc...I want her to pay one way or another.
 
Once you've sorted out how to get your justice on this, do yourself a favor a grab some 3M adhesive remover to get that b*tches paint off your car. You can probabaly get some at home depot.

Getting even:

You could spray some paint stripper on her car
Loosen the oil drian plug
Drain out the trans oil
Sugar or egg in the gas

But she Will point the finger at you.

Why can't you file a hit and run with the police?

Ya, ya first thoughts, that's childish, be a man and deal with it, ****ty people do and get away with ****ty things. No sense dropping to there level. Actions like that is probably why that kid ahot all those people, cuz for some ****ed up reason thought he was doing right
 
Call a tow company when the vehicle is there. Look around your lot for one of the tow company signs and call that number. They will be the company that is contracted with the apt complex to tow vehicles. They love to tow vehicles. If he/she doesn't pay the tow/impound fee in a certain amount of time, the tow company ends up owning the vehicle. That's about the only way to legally get back at them. If it was me, I would just move on, pay my deductible, and get my runner fixed.
 
I have called the police to report it, they came out but they wont do anything because it wasn't in the street, it was on private property. I called the tow company and they will only tow a vehicle at the request of the apartment office and they wont do it.

Oh, and since I have a squeaky clean driving record, I had my collision deductible at $1000. So now that comes out of my pocket to get this fixed for that idiot...again, one way or another, she needs to pay and be off the road.

I was hit by an uninsured kid in my 66 FJ40. Me and my uncle basically just told him if he didn't pay me $1000 to pay for my repairs then we'd take him to small claims. You gotta play hardball. Get a lawyer and get him to scare the crap out of this woman til she pays.

I know it is frustrating, but that is the REASON you have insurance, is it not?
I mean really, it's just a vehicle.

Have you actually spoken with the person? Don't make assumptions about her, you do not know why she was out in the early AM.....maybe works the graveyard shift?

Again, I understand how frustrating it is to have your vehicle damaged, but life is too short to let it get to you.

Find out which of the apartments is hers, stop on by and have a chat with her about the damage and that you've already contacted the insurance/etc....

If she's got a brain, she'll settle with you, otherwise sue her bigtime

I don't know if this was directed at me or not, but I am trying to "get even" with this person legally. Having the vehicle impounded for no insurance, getting a license suspended, fines..get them off the road before they possibly seriously injure someone and not have insurance.

Did I forget to tell that this person lives IN THE BUILDING OVER FROM ME? I don't need to know this person to see what kind of character they are, their actions speak for themselves. How could you hit your neighbor's vehicle, not leave a note or anything and park in a space across from me like they didn't do anything? And it also says alot that this person is not responding to insurance sending letters and calling her. It is not the fact that the truck was damaged, its that fact that the truck was damaged and they think they are going to get away scot-free.

I'm just playing devil's advocate here, but it is possible she doesn't even know she hit you.
My wife just 3 weeks ago came to show me that the front of her car was "damaged" by someone in the parking lot at work. After looking at it for a little bit I realize that she had hit the side of OUR garage while backing out and didn't even realize it. I showed her how the damage lined up with the scrapes on my garage. She didn't even know she had hit something hard enough to scrape all of the paint off of her bumper.

My point is, you never know until you ask. It is obvious she hit you. If it is a hit and run, I hope she gets what she deserves. Just be sure you give her the opportunity to make it right, before you throw her under the bus.

People suck, that's all there is to it.

Long time ago I came out to find my mustang with a big dent in the side. It had snowed the night before and the only tire tracks in the fresh powder were those that lead from our neighbor's drive way right into the side of my car, and then heading off down the street. No footprints so obviously the guy didn't even bother to get out to see what he had crashed into before running off.

Eventually he paid up after the cops showed up with the pictures I took in hand (this was before digital so I had to actually go get the film developed!) but again, people suck.
