dealerships/salesman issues

So I signed a contract last week for an SR5 with 3rd row last week for a vehicle thats on a ship. It is expected to arrive next week.

However, my issue is that the price that I agreed to was for dealer to include all weather mats of which my salesman said was available. Come to find out that oem all weather mats are discontinued and now they will just give me carpet mats (which i did not want).

I am disgruntled being that the price I agreed to is $200 more than my bottom line, but gave in due to the all weather mats. Since I signed contract and put $500 down, what are my options. Do I have to settle with carpet mats or can I push for $200 credit back?

Thanks in advance

You can do whatever you want. A deposit is not a sale, it just means they can't sell it to someone else until you make a decision, nor change the terms of the deal without your permission. Get what you want or walk away, there are other dealers willing to work with you.

Even if its an honest mistake about the floor mats, to a certain degree, that's 'bait and switch' in my opinion. I think you should be able to get your deposit back, you put a deposit down on a certain vehicle with certain options, if they cant fulfill that then its time to renegotiate, or walk away, with your deposit.

Sounds to me like your salesman wasn't listening to what you wanted. I would go back to the dealership, and explain your situation. Let him/her know that you are willing to take delivery without mats, and ask to have the price reimbursed. I'm with SeattleMike on this one...I don't think a dealership is going to screw itself over floor mats. I'm a huge believer in getting exactly what you want.

A contract is a contract. If that contract included all weather mats, then the dealer doesn't have the option to give you carpet mats and be done with it. Either the dealer provides you with all weather mats, or you can buy some yourself and make the dealer pay for them. Given the amount of money that is at issue (for the mats), I doubt it goes much farther than that, but you should be on solid ground if you have to take them to small claims court.

All weather mats are only $100, if they want they sale they'll flip you $100 to get them yourself. Otherwise they can return your deposit and sell the car to somebody else.

Thanks, that is good to know. Glad I still have some leverage. Will I lose my deposit?

You shouldn't loose the deposit if you back out of the deal. I had to put a deposit down on mine, and I asked them about it. My dealer said it would be returned to me.

This really is a non-issue. If you feel like you got a good deal, then screw the dealership; you should enforce the bargain. Presuming your contract actually provides for all-weather mats, then you have them coming to you, whether that means the dealer buys them or you buy them and have to sue them in small claims court for the cost (highly unlikely).

It is called buyer's cover, and it is a part of the Uniform Commercial Code, a version of which almost every state in the Union has adopted: UCC Section 2-712

How many dealerships do you think pull this nonsense because they think that people aren't going to fight them on something worth a couple hundred bucks?

You should be able to get it back, unless your 4Runner is a "special order". Most of the time the deposit is a 'good faith' deposit, just showing the dealer you're serious about going through with the purchase.

I think people in general need to 'lighten up' a bit, it is not the end of the world. That being said just be nice and reasonable. Most sales men/women have no clue what comes with each vehicle (from my exp at least), so I would honestly bet he thought he could get you a set. I doubt he was bragging to his friends he be was able to con you into the sale with all weather mats that do not exist. Just tell him you paid the extra $200 for the mats, then ask him to drop the price by that amount of have them order the Husky/Weathertec ones for you. They are not going to loose the sales over a minor detail like this. Be nice and you should be treated the same, if they are a decent dealer!

If you can't get this corrected with the salesperson, ask for a manager or customer relations and I can't imagine this not getting resolved over a $100 set of mats. Should be an easy fix.
