Here you go gentlemen.

What it looks like is you are missing a washer on top.
But it doesnt look like you could put 1 in there and tighten down.
I bet if you pulled the assembly out and separated the shock, you will find it made a oblong hole on a washer that's supposed to be in there, or it's missing and made a hole on your top hat area.

Here you go gentlemen.

It looks like you’re missing a bushing and a washer. That will allow you to tighten the nut down snug
