A: No, with some exceptions. Open carry is not legal in Texas, but you may open carry on your own property, in the commission of a sporting activity (competition, shooting ranges, etc.), and while engaged in hunting.

A: Yes. With the passage of the Motorist Protection Act you may now readibly carry handguns, loaded and within reach, so long as you conceal the firearm. Long guns (rifles / shotguns) do not have to be concealed and may be loaded and within reach.

I lived and worked in TX for quite a while and this was one of the more paradoxical things about the state. You could drive a car WHILE DRINKING A BEER (at that time in the 80's); you could shoot a guy running off with you TV, and yet...
 
BTW, the App for conceal handgun owners I mentioned above is called, "POSTED"...avail for both iphone and android. On Apple store, there are two apps with similar name...so check the selection before installing. I believe that it is 0.99.

This whole argument comes down to this...you need funding/manpower to enforce the current laws and regulations. THIS should be the main focus! We don't need more laws & regs especially when we don't even have enough funding/manpower to enforce what we already have!!

Unfortunately, the passing of useless laws that are never enforced is what keeps politicians in office. It makes them look like they are doing something about it to the naive public.

I have proposed this idea before, and been met with much vitriol, anger, and downright hatred.

Disband the DEA, provide that funding to local and state cops, repeal ALL federal drug laws, and let the states handle the issue themselves.

More progressive states will treat drug use and abuse as the health issue it is, and less progressive states will simply continue the old ways of ban and destroy, which only serve to create a problem where there is none.

A cop that patrols my neighborhood is seen more often at McD's than on the streets...and yeah, he's extremely overweight. But, based on RandyDaytona's logic, hey, i see ENOUGH of his kind to say that there is an ALARMING NUMBER (!!) of morbidly obese slow moving cops that spend more time at donut shops and McDs than patrolling!!!!!! BUT, i do not mean a majority of cops are like that...i just see an ALARMING NUMBER of these fatsos slugging around our streets to come to that conclusion! Fair?

Perhaps so, but given the fact that we actually have to meet physical standards in order to get hired, I'm pretty sure the percentage of officers who are overweight pales in comparison to the number of citizens who are the same, yet are still walking the streets armed. Unless you actually had to take a physical agility test and medical screening when you got your CCW permit - ? Your analogy is creative, but far from accurate.

Look, i see what cops have to pass for their shooting competency...it ain't that hard! My mother could pass it. I am sure that you have additional training in whatever RD mentioned above...but, lets not exaggerate at how perfect cops are. Lets not. You would be foolish to do so.

You "see" it where? Have you done it? Only the actual 'test', or all the other tactical training that goes on in addition to the test, itself? Do you shoot a timed course, from the holster, with reload drills, stoppage drills, simulated stress introduced (like having to sprint 200 yards, carry a simulated 'body,' or arrest a suspect... and THEN fire the course?) Have you (or your mother) done room clearing, low light shooting, one-handed shooting, ground shooting, or weapon retention drills? Do you do it regularly, as in 4 times a year, minimum? Have you actually attended a law enforcement academy and had to "shoot for your job," meaning if you fail you're fired? I have (no pressure there).

Or are you just an overly-opinionated person who owns a gun and doesn't believe that any viewpoint outside your own could possibly have any validity to it?

I never said anything about cops being "perfect." YOU did. I never even alluded to that idea. I said that after a career of carrying a firearm and bearing the responsibility that goes with it, I think my training, experience, and tactics are better than someone with minimal experience who walks into a store and buys a gun. Another creative analogy and attempt to put words in my mouth and discredit me, but again, far from accurate. Yeah, let's NOT exaggerate. Might want follow your own suggestion.

Not sure where RD lives, but around TX, CCW holders are very much unknown...because they (including myself) don't identify themselves to the public. Only my family knows. My friends do not. My colleagues do not. My neighbors do not. So, how exactly does a criminal know that i am carrying and thus IDENTIFY ME??? Hint...this is why it is called, CONCEAL CARRY. We're not open carry here in TX (yet).

Maybe you haven't done it, personally. What I said was I've seen it done many times. "HINT:" I said this was in my experience, and I've lived and carried a gun in MANY more states than just Texas. Before you start bagging on my experience as being so limited, you might wish to expand your own, because right now - as far any gun-related topic goes - you really don't have enough to challenge mine. Or the majority of the other members posting here, for that matter.

I swear, if a neurosurgeon came on this forum and started posting about his or her experience with wielding a scalpel and discussing the ins and outs of synapses and brain tissue, you'd tell them they were full of it, wouldn't you? Must be nice to know everything...or to at least have "slept at a Holiday Inn Express" the night before you post on any given topic. What should we all talk about next? Nuclear physics, ceramics, bread-making, the anatomy of the South American tree frog? Don't bother - Thai knows it all. He is "The Most Interesting Man in the World..."

It's obvious that you can't let anyone have an opinion on this forum that disagrees with your own. If a differing viewpoint bothers you that much, I'd suggest staying away from the internet altogether.

Gun control does not equal banning all guns. I'm tired of seeing this ignorance being repeated over and over.

Equating gays to pedophiles is also extremely ignorant.

The proposed ban by senator feinstein does in fact ban nearly all modern firearms. if you haven't read the ban, you should do so. that proposal is not gin control, it de-arming americans, which is a problem and unconstitutional.

Have you signed the petition against it (although it seems a bit premature as there is no formal proposal before the Senate yet)? There is a petition against it however.

If it is unconstitutional then I'm not going to worry too much; it won't make it into law and it would surely get struck down. I'm not saying don't pay attention, but I certainly will spend my lettering writing efforts on other things first.

my gripe is that senators think they can take away constitutional rights so easily. Written letters to all my reps. This following ling is a good read. its not the official doc, rather an outline of the new ban. its scary.

Boy, RD, you sure assume a lot. How do you know that i have NOT done it? I am just saying. Yes, i have seen and done your firearm competency test. You're right...i did not go thru the re-holstering etc. stuff. BUT, i have seen what it takes to pass the accuracy test. And yes, i have passed it...easily.

Ok, so, if cops are not perfect, then why do you expect civilians to be? That was my point. You missed it completely. Instead of concentrating so much on my analogies, maybe you should think a little bit before responding. The problem is that cops are almost never at the scene of the crime when it happens. I am sure that cops are better trained than me, but it is a moot point if they are NOT there to protect me and my family at gun point...and only arrive afterwards. Remember, CCW-holders are NOT cops...we do NOT go out looking for crime. You seem to miss this very point over and over again. Carrying a weapon by civilized folks is to protect themselves. THEREFORE, passing laws & regulations to limit such is damaging.

Here is an analogy for YOU. I am almost sure that i am better at CPR and "coding" someone in cardiac or respiratory arrest than a "civilian". HOWEVER, does that mean that I crap on anyone who tries or learns CPR and proper techniques?? Do i prevent someone who is trained specifically NOT to do it simply because they are not in my line of work?

Bring hard data to the discussion. This was why i made fun of your stories with my very own experience involving mobidly obese officer at McDs. Get it????

These internet forums are best served by making a concise post (just one) and not getting into a debating match with the high post count guys who use forums as their own personal chat room.

I monitor some forums where a small group of yappers has to respond to each and every post, multiple times. It's common on some sub-forums here on T4 as well. Mostly noise.
 
If you are a felon, you cannot own or possess firearms.
If you are guilty of a violent misdemeanor, you can have your firearms taken away and similarly cannot possess firearms.
If you are deemed legally incompetent and a danger to others or yourself, you cannot own or possess firearms.
If you are an illegal alien, you cannot own or possess firearms in the United States.
Etc, etc. There already exists laws to control who can or cannot possess/purchase a firearm for everything you just mentioned. The government that made those laws is simply piss poor at enforcing them and often breaks them (Operation Fast and Furious anyone?).

Laws already exist that are meant to restrict gun ownership and usage. No new law is going to make any difference if the government cannot enforce the laws in place.

According to FBI and US DOJ statistics, ALL violent crime...to include gun crime has gone down since the expiration of the AWB. So, no new gun laws yet gun crime is going down. On the other end, more semi-automatic rifles have been sold since the expiration of the AWB (which the FBI has flat out said did absolutely NOTHING to reduce crime) than ANY other time in history...to include when full-auto was purchasable without tax stamps or BATFE approval. Yet gun crime continues to fall.

ETA: CCW has grown in popularity across the country with more and more people carrying everyday. Gun crime is still falling, so your anecdotal evidence does not support the reality. In fact, what statistical evidence there is shows that CCW holders are FAR less likely to commit crimes than the general population. There will always be dopes, but so far, those dopes haven't caused any harm and for the most part have prevented or stopped crime when it occurs. The Clackamas mall shooter was stopped by a CCW license holder who drew on him. The CCW actually drew and did not fire because he saw innocents standing in the line of fire (behind his target...one of the four rules of weapons safety). Additionally, you see people with piss-poor training open carrying firearms on a daily basis (they're called police officers...remember the NYC shootout??). I shoot more in a month than the average police officer in a year. If only the general public knew how little most police officers practice with their firearms.

Other than a felon not being able to buy or carry a gun, I've seen loopholes exploited with everything else you mentioned. And a lot of that enforcement depends on the state, anyway. Also, gun shows and private transactions will also allow purchases to be made by anyone with the money, including felons.

For every example of the CCW-holder who is a hero and stops a tragedy, there's another where the person does something stupid. The NRA and the anti-gun lobby love to play the "let's-trade-stories" game, but the fact is there are just as many of each.

But my own opinion is based on the people who've done stupid things in front of me: like the idiot who rushed up to me while I was making an arrest, with a drawn weapon and a "CCW Holder" badge around his neck and asked if I needed "assistance." He almost got shot by my backup for his trouble.

Or the guys around here who think nothing of hanging out at the local bar while armed.

Or the family friend who was bi-polar and was able to purchase a handgun. Don't know what method he used, but he owned one, nonetheless. And one time soon afterwards when he went off his meds, he ended up getting into an argument with his fiancé, locking himself in the bathroom, and blowing his brains out. Tragic, but at least he didn't do anything to anyone else. He could have, though.

I think violent crime ebbs and flows, but things as ridiculous (and mainly for political show) like the Assault Weapons Ban have little to do with it. Anyone with a shred of gun knowledge knows you don’t need an AR-15 or hi-capacity pistol magazines to commit violent crimes. I don’t think there’s actually been any legal measure regarding firearm restriction in our lifetimes that was meant to be an actual solution.

And I’m not sure how extensive your experience is with regard to law enforcement shootings, but when they go bad, it’s rarely due simply to “piss-poor” training and more to do with circumstances, adrenaline, and Murphy’s Law of armed combat: shi^ happens. If you’re referring to the Empire State Building shootout, yeah, I think it was a bad outcome, but sometimes your choices are bad and worse. What should they have done when they guy pointed his weapon at them? Let him shoot them, then turn his gun on the crowd? Or try to take him out and hope no bystanders were injured? I learned a long time ago not to Monday-morning-quarterback another cops decisions in a shooting incident. I don't know what he or she saw, what they were thinking, and I have a limitless amount of time to do it - when they probably only had split seconds.

Moreover, for every ‘bad’ incident where police are involved, there are a 10,000 other incidents where they do it the right way. But that’s not as sensational, so it doesn’t make the news. If you’re expecting your police to be perfect and never make any mistakes, you’re expecting way too much, and to paint all of law enforcement as having "piss-poor" training based only on what hits the media is a huge mistake.

As far as how many rounds you shoot in a month, a lot more goes into ‘quality’ training than number of rounds fired. Solid instruction, past training, experience, awareness of legal issues, individual judgement, use-of-force policies, and sound tactics all play a role. Unless you're talking about introductory training, i.e. teaching people new to firearms in general, I'd say the number of rounds fired is the least important facet of good training.
