I Won My Lemon Law Case !!!

Well I had my arbitration hearing today for the seat rattle and Toyota has to buy back the 4Runner. If you are having this problem GO LEMON LAW !! Make sure every repair order says the exact same complaint. If I had to go through this again I would get an attorney, Toyota's attorney's are slick. Don't live with this problem, GO LEMON LAW :D

Yep, getting an attorney is what I did last year when my new 02 Explorer was on it's third tranny in the first 1200 miles. I skipped the whole arbitration B.S. and I had my check in 45 days.

Documentation is everything. It's essential that your work orders and invoices show the same symptom every time and indicate the correct mileage in, mileage out, date/time in, and date/time out. As a matter of practice now, I plan to make sure all of my work orders show any symptoms in MY WORDS, not the interpretation of my service adviser.

Hopefully this doesn't become an issue with my 4R. So far, my seat is fine ... and tranny too. ;):

Congratulations on the win. Your seat must have been really bad to have it declared a safety issue.

Sorry to hear that you had such a problem, though. Now you can get it behind you and move on to something else -- and hopefully you won't run into the same problem again.
 
Yea.. the seat had alot of play in it and was getting worse. They know they have a problem with it but their not doing anything about it. Thats why everyone that has this problem should complain.
 
Congrats!!! I'm really happy for you. I know exactly what it feels like to win a Lemon Law. Mazda had to buy back my miata!!!
 
Thanks everyone :D ..... This is the wifes ride so im not sure if she will stick with Toyota or go elsewhere, we have owned Toyota's since '95. I guess its car shopping again....

I checked your older post and found-out.

I have similar problems such the seat coming up if you lift off, the whole seat rocking back and forth if you tug on it from outside, a shift around some curves and the infamous sinking that happens over a shor time.

I just spoke with my local dealer and they want two hours to check the seat!!! Unbelievable that they would want me to have to leave the car, get a rental and all so they can check this. In addition, they claim to have no knowledge of the problem.

All else with this truck is great. I love the vehicle and actually could live with this if it doesn't get any worse, but I do have a warranty and and the extension...so I want them to fix it!

If your seats moves now its only going to get worse. Make sure you document the exact problem on the repair order everytime you go to the dealer just in case you have to lemon law it.
 
rattle-lemon law..

Bringing in my 03 limited 4runner for the 4th time! 3rd time for numerous rattles, once for gas cap latch not opening. This really Sucks!
Not to mention the Sulphur Farty Stink!
Oh yeah..had a problem with the JBL stereo too. No Volume. I shut the car off and restarted it and it worked again.
I bought the car in November of 03 and Wed will be the 4th time back!!
I had 2 pathfinders b4 this and Never had a problem.
Do i pursue the lemon law?
I really Love the 4runner though...i just wish all this wasnt happening! Thanks for listening.

In most states, the lemon law applies to safety issues or problems that render the vehicle inoperative. And it usually requires the same problem three times without successfully being repaired.

However, the laws do vary by state and you will need to figure out what the lemon law for your state says.
