Man in the middle attack involves the hacker providing his public key to one or both endpoints, that's how he gets in. Key management can be hard, regardless of where they are.
The other hacking way is to have gained access to the device/computer prior to the message being encrypted.

This presentation by Mark Stein relates well to this topic. It is a broader presentation on Conservatism and the facts of life. He goes through political issues in both the US and Canada. Well worth watching/listening to.

32:35 He talks about how these regulations and intrusions into freedom/privacy are "redistributing societal energy from the productive sector to the obstructive sector. Fact of life: Big government makes small citizens."
