Does anyone know how this works? I was told that if a new car has the same problem 3 times or multiple problems, one can get a new car or full refund if manufacturer fail to repair the problem in a timely matter. How does a car fit the new car profile? Does it have to be under a certain milage or is it related to the length of owenrship?

Has anyone excercise the lemon law in the past?

Your advice and input is highly appreciated.

P.S. I found a law firm which claims they can resolve the lemon law claim at no cost. I wonder if this is true. Law firm's link below.

OK I found some more detail. "a nonconformity in a motor vehicle to the manufacturer or its dealer during the first 18,000 miles of operation or during the period of two years following the date of original delivery to a consumer"

Yes it is my new 4Runner. It kills me to think that this is even crossed my mind about a Made In Japan Toyota!!!!!!

I am actually wondering if my situation applies under the lemon law.

I have a new 4 Runner. I noticed the left rear of the car leans 3 days after the car is purchased.

I called the service center and they told me it's possibly due to the full tank of gas but of course they are not certain, they need to see the car. (Also called Toyota customer care 800 number. NO TSB on this) Since I have been very busy the last week (Out of town due to work) and they won't take me in on a Saturday, week days only. (They claim they are not set up to do this type of diagnostic or repair on a Sat. Two dealerships confirmed this) I decided to observe this situation and wait to see if things change after the gas tank is below 1/2 tank. So now I have 1/3 tank left. Left rear is still leaning. Fender to tire is still 1"+ less compare to right rear.

I've parked my car next to other new 4Runners to compare and took measurements. It turns out my car is the only one which leans to the left. ( all other brand new 4Runners do not have this much difference. Some looked leaning to the left but when I actually took the measurement, the numbers came out OK)

I've posted on this board concerning this. Some say they have this problem. Some don't.

I have an appointment to goto the dealer next week. (Have to leave my new car with them all day since I can't take off from work and wait there to watch them. This really pisses me off too!!!!)

The real concern for me is the following:

- What if this is not a big deal but when I take it to the dealership, they end up screwing up something else. (Lack of confidence in the workmanship and dealership these days)

- What if they do not agree this is a problem. (Although measurement tells me it's off by more than 1"+) Is there anything I can do? Can I do anything to get a new one? Would the lemon law apply?

Some people have told me to just ignore it but it really bothers to know about the 1"+ difference. Since it is not gas tank related, I also wonder if it's something to do with the X-REAS fluid suspesion, shock, frame or .....Maybe something did screw up during production, or got damaged while it was in transit to the dealership.

So I am trying to collect as much info as possible before going to the dealership next week.

By the way, even if I can excercise this right, I do not want a full refund. I just want a new "perfect" 4Runner as I really do love everything about the car. Except the 1"+ difference in rear left.

Hoepfully it's not a big deal and they can fix it.

Honestly, I would think there would be a way to adjust the height to a certain degree. I'd give the dealership a chance to correct the problem, and see what happens. It usually takes 3 visits to the service department for the same problem before the lemon law applies.

Yes, I hope it's a minor adjustment. Nothing significant.

I totally agree , just give them a chance to see what's going on. I know a little lean with a full tank is normal so my suggestion is to take it in almost on empty. maybe (1/8 tank) so they can't even go there with the fuel thing.

Could be an XREAS thing too.

I also think it might be pretty had to get the lemon law without having a mechanical problem. like a motor , tranny or rear end.....you get where I'm going with this. BUT go get them and don't give up until your satisified.

Tell the dealership to install a new set of springs. Ride height is determined by the coil springs and I'd guess that you might have one spring that is out of specs.

Where are you located? State wise.

Is it a lot of work to install new springs?

Springs are fairly easy, especially when you get the dealership to replace them under warranty.:

I'm sure it will be fine to drive your 4Runner.

Like I said earlier, springs determine ride height. It sounds like you might have a bad spring, but it shouldn't be unsafe to drive. After all, we're only talking an inch difference.

I have had 3 lemon law cases and won all 3, in CA

First was a 02' Dodge dakota for a stalling issue, second was a 01 Corvette Z06 for too many problems to list, and the 3rd was a 05' Lexus GX470 for the dreaded driveline thump.

Not sure about NJ, but in California lemon law attorneys take cases on a contingent fee basis or with a refundable deposit, that they get to keep ONLY if they win the case. So knowing this they will not take a case unless they KNOW there is a 95+ % change that they will win the case.

For the most part, it is 3 repair attempts with the problem still present after the 3rd attempt, or if it is a safety issue (which yours is not) 2 times within the first 18,000 miles.

The other is more than 30 days in the shop for the first 12 calendar months of ownership.

There is a mileage deduction fee from the inseption of the issue. So if the problem started at 3K miles and it is documented, then no matter what the mileage is at vehicle surrender, the mileage off-set is only caculated for the first 3K miles.

While it was nice to drive these vehicle around basisly for free, I would have liked to been spared the issues that I have had. The most bittersweet of the 3 vehicles that I had to turn in was the Corvette Z06. I SO loved that car and the performance side of the car just absolutley rocked. Performance wise, it could not be touched in acceleration or handling except the likes of a Viper, Porsche or Ferrari. Which besides the Viper ~ 85K - 90K are all 150K cars.

I will say in its defense however, that I had an 04' Z06 with no issues, baby forced that sell.
