To late. The first things said were obviously their true colors. Damage is done.
Plus it's glaringly obvious that they didn't intend to ship many of these products. Look at the 4runner rear bumper. How many were ever produced? less than 5? I think it's probably just the two beta versions. They have been saying since July they were in production. Obvious lie. That is blatant deception of at least 77 people. (Figuring 79 original orders.) Plus who the hell posts this sale thread when they already have 70 orders?!!!! That's insane! Three days after this thread was posted I ordered mine and I was number 73!!! Had I known that I wouldn't have ordered

The fact that people are liking their comment just shows you how many idiotic fanboys they still have that believe in #pelfreybiltfamily. SMDH. Those people got their products and didn't have to suffer so they'll goto any length to defend pelfrey. It's like some damn cult. They are cons, thieves, and scum. Nothing less. A fake late apology doesn't cover that up.

i put a 50% deposit on a base rear bumper 11/3. Got shipped 7/3. I was #1 to order the base rear bumper.. Possibly received the ONLY non beta bumper. Have only ever seen 1 picture of this bumper on another 4runner.

I thought I should chime in here and forgive me for the newb status on post counts, and again for not reading the whole thread... I don't know if this has been stated already regarding the customers that paid via credit/debit card and have not received their products...

I am in the Merchant Account business, I am a high level risk management expert in relation to Visa/MasterCard/Amex/Discover member bank rules and regulations...

Pelfreybilt had a merchant account, and I am sure their bank has shut it down by now, even though this surely already has happened or will happen, the bank that underwrote the merchant account is responsible for all the transactions, regardless of whether or not Pelfrey declares official bankruptcy.

Part of the guarantee that consumers get from the card brands (V, MC, D & Amex) and the member banks issuing cards to their customers, i.e. your credit or debit card, is that you can "chargeback" or "dispute" the transaction if you have not received your order, and the rules change when there is an advance payment for product orders, so if your own bank says you can't dispute because of the age of the transaction, you need to say to them that it was advance payment for a product and typically you then have up to 365 days, and in some cases, 545 days from the original transaction.

Just know that not every bank support for disputing transactions is versed in the fine print and different types of disputes, so know that you paid for a product to be made, and then delivered at an advance date, and now the merchant (Pelfrey) is put of business and refusing to deliver/refund, this also is relevant for merchandise that was flawed...

Try again and specifically cite per the card brand rules that the chargeback protection period of 180 days is extended from the original transaction date to the delivery date. And if Pelfrey extended that date, then the extension is an updated This exact situation is the 545 day exemption... original transaction date plus + 365 days + 180 days (normal dispute time allotment) = 545 days

Any rule changes by the card brands are not retroactive, they only apply from transactions moving forward, you should be covered, I will post the rules later this evening for Visa and MasterCard once I have a moment at my desk later

Here are the pages from both Visa and MasterCard.. Visa, you have 540 days from the original transaction date for future delivery.. MasterCard, you technically have 120 days from the future delivery date OR the date that it is determined the merchant is no longer in business....

Be vigilant, I am pretty much certain that no phone support rep you are talking to actually knows the rules, they only know their own companies established procedures... ask to talk to a higher up.. and keep going, and email them these pages, because then, they are in violation of MC/Visa rules if they dont do this correctly...

What about an ACH transaction? Any recourse there?

ACH is a little tricky but yes, you do have the same 'sort' of guarantees, I will get into those later, need to do a little re-rereading of those for y'all...

So I obviously haven't had the opportunity to really look into this. But my name apparently doesn't appear in the Bankruptcy documents. I have heard this second hand as I don't have a copy.
What does that mean? I was told I could then file against Pelfreybilt Inc. rather than the Pelfreys?
I'll be contacting the counsel tomorrow and will post back info then for anyone who is in a similar situation.

Threaten? They deserve to get scalped, or pretty close to it. Justice for con artists is more about eliminating THEM as threats. But, hey, if anyone can get their money out of the empty dustpans they left behind when they picked up and ran, more power too them.

Thankfully I didn't go for that rear bumper, but god knows I wanted to. Same goes for that front Al bumper. I dodged this one...

yes, the docs are on tacomaworld. tyler filed in 2001 and satin in 2009, both chapter 7, both before they were married to each other and way before pelfreybilt was started
