Care to elaborate on this? I'm not taking his side, but just genuinely curious. I had spoken to Tyler on the phone before and he seemed like a good guy.

I saw his new wharehoue in person and talked to him face to face. Bet he seems cool and a good guy on the phone.

I can always judge a persons personality on the phone! Jeez

Did it feel like he was trying to sell u a time share in the bahama's type of thing, as if he had a bumper in the showroom, but no actual bumper to sell??


IF so, i would have walked too.

I walked b/c they quoted me a insane price and wanted cash up front and I'm local too.....yeah....no thanks dood.

How does the filing Chapter 7 protect a person from credit collection, and other legal proceedings?
The moment Chapter 7 is filed the automatic stay goes into effect which acts as restraining order against all collection and other financial legal proceedings pending against that person. After the case is filed, the court will mail a notice to all creditors ordering them to refrain from any further action against the person. Any creditor who intentionally violates the automatic stay may be held in contempt of court and may be liable in damages to the person filing.

I remember this time last year Tyler and him hanging out in the new wharehouse when I visited. This was when Tyler was showing me the rear bumper he was going to release.

This was when I decided not to buy. I’ll leave it at this, the place seemed all show but no go! Like he didn’t want to sell to a local San Diego customer.

So what you are saying is that you DIDN'T buy the bumper, therefore you don't have ANYTHING productive to post in this thread for those that are here to try to resolve an issue and get their hard earned money back other than you thought that based on your observations the company wasn't all it was cracked up to be... And on top of that, you want to harass another forum member who has done a lot for this community and happens to be caught up in this mess just like everyone else.... Dude, you need to rethink your priorities and motives before clicking that "Submit Reply" button at the bottom of the window.

Well, I would advice people to seek advice from a competent attorney b/c chapter 7 doesn't protect them from criminal proceedings if there is evidence of fraud and a resulting civil lawsuit if they were found to be defrauding people prior to bankruptcy.

I have been following this on all the social media I am on (fb, insta, TW, and here) for the past couple days. It is sickening, disheartening, and frankly scary...

To all of you who paid your hard earned money out to get a product and never received it: DISPUTE, DISPUTE, DISPUTE!!!! There is a ton of great info here and on another couple threads in TW about what to do and how to go about it. Do not give up fighting, and I will personally send positive words of motivation and reinforcement to you if you need it. Also here is the link to the best TW thread [MENTION=118909]MTgirl[/MENTION] posted here.

To those of you that have no skin in the game, like me, learn from this lesson. It is hard to swallow, even from the sidelines, but support those fighting the good fight to get their hard earned $$$ back. I know what the pelfrey's did is terrible, horrible, and maybe even premeditated based on their previous history of experience with bankruptcy, but publicly bashing them might make you feel better now but it isn't doing anything but lighting more mob torches. I have changed what i can control: Consolidated slider info thread (linked in my sig), but other than that I control nothing except my own actions and words at this point. Thats why I want to support those trying to get their honest money back.

I will not forget this. If they startup elsewhere I will NOT buy from them, I will NOT support what they did to the offroad community, and I will remember their faces, because they can change their names but their faces are a bit tougher...

During Lone Star Jamboree this year, they were still pushing that bumper hard wanting deposits and money up front. They touted that thing around, but it definitely gave me the vibe they were not selling or had something going on. When approached about the actual # of bumpers out there they shrugged it off saying they wanted to make some finishing touches.

I had a lengthy conversation with their people and Tyler himself. Nothing struck me as odd except the overwhelming urge to move product before it was ready. Most fabricators tell me to hold on and they'll get a list and then call when money was needed for production. These guys were talking about "give me money and i'll get you on the list". During that conversation, I just thought it was pushy salesman BS, especially at Jambo. In hindsight, well... yeah.

The fabricator and vendor I deal/work with has always had the same approach. No money needed until product ready to ship. Sometimes we take very little deposit just to hold the line. In this case, I understand they took SEVEN HUNDRED THOUSAND SOME ODD DOLLARS (~$700,000) in orders and/or money taken knowing they had THREE HUNDRED THOUSAND DOLLARS ($300,000) in debt. There's no way they didn't know they could not cover that debt. You can't possibly accrued a million dollars in debt and not know bankruptcy is looming. They had to have known their receivables or lack thereof. In addition, it looks like Tyler and Satin both filed bankruptcy in the past. Being in my field (corporate attorney), we've seen too many people wise up after one bankruptcy and "do it right" the second time (if you get my drift).

I've looked things up on PACER myself, and I'll reserve judgment for the BK judge. Anyone know the exempt property statute in California and whether they intend on filing personal? I feel they'll be back at it again in a few years. At least their business model is repeatable... in a sense at least.

was posted that they filed bankruptcy personally in their names. Not Pelfreybilt.
 
Pretty simple, I don't even think the employees at Pelfreybilt saw this coming. Nothing there tickled my bullshit radar. Either this was negligent and Pelfreybilt dug themselves into a hole, and suddenly realized they were screwed. Or they knew this was coming and it's irresponsible and possibly criminal. That's for the legal system to decide. We don't have more than internet sleuthing and trust me we all want to know what the facts are in this story.

As for the 4Runner, I was contact about someone buying it august 13th, agreed to sell it August 20th. Way before any of this became an issue. The shitty part is my memory of the 4Runner, anytime I look through old photos, will always have the stink of this debacle on it by association. My leaving will always have a stink associated with it.

As much as that sucks, it doesn't suck as much as what others are going through financially, and their mental well being. As I said this is not my story, it's the story of a lot of people trying to be made right again.



The mods have made it clear on TW, right now do NOT harass the judge on this case. Please be adults, composed, and calm. Do not undermine things by being angry in your communications to the judge.
Member TLA over on tW has been posting some very, very good information regarding the matter and this is his recommendation.
I was not advocating calling up the judge and blowing up his/her voicemail, but as a victim/customer you can draft a letter to add color to the narrative especially if they were still collecting money knowing full well that they were not going to deliver a product.

Yes best way to describe was that I saw his place in person and he didn’t seem to like that.

I saw the bumper while it was still a prototype, almost exactly a year ago today.

I asked if he would consider a local deal. Only because I was going to pick it up and also had to pay local sales tax. No budge. I was going to buy a front aluminum bumper and sliders.

Glad I didn’t as a shop in Escondido I’m a customer of, was placing a new front bumper on another customers 4Runner.

That shop manager told me he had a horrible time getting it to fit and told me to look for another. He was not impressed!

Great shop who told me to stay clear! Glad I did.

I feel bad for people’s losses! I was lucky to live near by to observe that’s it!

Plus I didn’t buy solely on the fact of a trusted shop who did an install on another 4Runner. He told me to stay away. That shop helped me out a lot and could’ve easily made a larger sale. They didn’t and made a customer instead.

You know what they are still in business because of the transparency and truthfulness by not selling me what they thought was crap.

Considering you are probably the supercharger MGM guy who was at pelfry,s shop, I wouldn’t expect you to “submit reply” but you did because you two are buds.

I like to shop local to improve the local economy. Therefore, my local shops told me “ not to buy”

I am glad that you had a good shop to guide you in the right direction, and that ultimately you ended up avoiding this mess. Good shops who care about their customers are hard to find.

That being said, my point was that the personal comment that you made about a fellow forum member was completely unjustified and out of line. Lawndart had nothing to do with this current situation, and truthfully didn't know any more about what was going on than anyone else did. Why you called him out specifically, unprovoked, I have no idea (and I reviewed all of the previous posts to make sure I wasn't missing anything). You are right, I do know Lawndart and he is a good guy. I also know for a fact that even though he helped Tyler design that rear bumper, he paid them in full for his product and had nothing to do with it's production or sales. You are also wrong, I am not "supercharger MGM guy". I have zero affiliation with Pelfreybuilt or this situation. But I will be damned if someone comes out and stirs the pot for no justifiable reason and doesn't get called out for it.

Either post useful, genuine information aimed at helping the situation this thread is aimed at, or take your personal comments towards other people and go elsewhere. It's that simple.
 
I spoke with my bank (Chase) since I paid ACH as well and they "temporarily" gave me back the money and it'll be final in 10 days after they investigate. The day I filed the claim the money showed up in my account. Hope this helps anyone that has Chase as their bank.

I got provisional credit to my account as well from a different bank. Since the charge was past the normal dispute range, they had to enter it manually after my persistence. Since I paid via debit MC, they have to send it to MC to investigate.
 
Just call me stupid...totally out of touch for a while and obviously way too trusting. Had been in contact with Pelfrey every few weeks since last Oct when I placed my deposit for my rear bumper. Right up until 3 weeks ago, when I was told 2-3 more weeks, and then just got the Chapter 7 notice indicating they were seeking full discharge of debts. So glad to be dealing with insurance issues from the Carr Fire and now screwed for $3618. :( Even told Satin I was glad to have my 4Runner to place the bumper on, when I checked in right after the fire...talk about feeling like being kicked while already down.

Don't get too discouraged...a lot of us had fully paid our invoices too and we're doing pretty good at getting it back from our banks and credit card companies. My original ACH deposit was 15 months ago. With some persistence with my bank, a temporary credit hit my account the next morning. My credit card had one of the charges back the same day I called them, on a Sunday! The freight shipping charge on my credit card also came back this morning.

With my bank, the first two people were both wrong...they CAN manually enter a dispute even with it being an ACH well over a year ago.
