Long story short, I went out to dinner today for my girlfriend and her sister's birthdays, her mom drove her GX470. We were going about 40mph down a city street, when BAM, some idiot in a 1995 nissan quest ran a stop sign going about 50mph, drove out infront of her car, she couldn't avoid it, so we T-boned him hardcore. We than spun, his wheel popped off and ricocheted off the side of the lexus. Thankfully noone was injured, my leg cramped up and I could hardly walk on it, but its fine now.
His car was totaled, the lexus's front end was smashed in so bad that the front 2 doors wouldn't open. Other than that, no cracked windows, airbags didn't go off, no other body damage past the front doors. The car started up just fine after the accident. But than when the police got in to move the car, they didn't move the front bumper out of the way and drove over it, popping all 4 tires lol.
My question is, if the car is totaled and she still owes money on it, what happens? Does the insurance give you money for what its currently worth or what? Thanks.
