So I was coming home from picking up a piece of pipe to do the ISR mod...and excited out of my mind for the goodies i was planning on getting this summer...and some lady cuts me off, then has to slam on her brakes. I did everything I could, but no use. And because there's no witness to attest to what happened, I got hit with a $164 "careless driving" ticket and the fault (FL is a no-fault state my a**...)

so I guess a question I have:
Is it worth contesting the ticket since I didn't have time to create a safe distance between me and her before she hit her brakes? Or will the fact that, having no witnesses and being a 19 y/o kid with a wreck (2 years ago) on my record, I hit her from behind keep them from even considering it?

I guess upgrades are on hold for a while, till I hear back about jobs I've applied for...

I would contest, I think you would be able to prove a point that you were cut off and she put on the brakes. I've never seen anyone just take off flying into the back of someone
 
Sucks man. Did she stick around? It's a losing battle. My sister rear ended a taxi that cut her off in the rain and then stopped. All four *******s inside it (only approved to carry 3 BTW) sued her and won. The tort laws just suck.

Yeah she stuck around and we got the report and everything filed, so now I have to deal with insurance tomorrow and decide if I want to bother fighting the ticket. I just don't think they'll hear me out, from what I've heard about these situations.
It just sucks because she cut in front of me, and btw she had no passenger mirror (legal, but helps my argument), had to slam on her brakes, leaving me with not enough time to stop or get out of the lane. I swerved, just caught her by about a foot and a half.
 
I was in a very similar wreck in FL and contested the ticket for the rear-ending (FHP said its an automatic ticket if youre the pitcher). Anyway, they have to subpeona the other driver and if she does not show on your scheduled court date they have to drop the charges(ticket) because there is no witness to put you in the drivers seat.

So you got off with no ticket??? Thanks for the heads up. I'll ask my rep tomorrow and see what they say. If there's any shot it might be worth the court cost.
 
Hey neighbor, sorry to hear about your accident. With lots of rain and crazy Jax drivers, I'm not surprised someone caused you to wreck. Where did it happen?

Diagram14's gave some good first-hand advice.
 
That sucks man ... but atleast you arnt in virginia. here if you rear-end someone you are always at fault

I was heading east on Butler, right before it crosses over Southside. Right around 5-6, so traffic was already insane...Sucks being the guy that backs it up even more! :mad:

And Diagram14 got my hopes a little higher, we'll just have to see how this plays out
 
you can fight it all you want but you are the one driving too close. You can be the safest
driver in the world but it's everyone else i worry about. just pretend every car is a motorcycle can you can never go wrong(extra space). good rule of thumb is 1 car length for every 10 miles per hour. sorry i know its sucks but hey it could be worse, she could have said she hurt her back...

Nah its the same here, at least at the scene from what I've been told/experienced. I can take it to "court" and contest it, but I have to pay a fee so if they don't drop it, its even more $$$ out of my already-thin wallet.

I was in the process of backing off. She cut between me and the car in front of me, then 2 seconds later had to slam the brakes. That's my argument here, that I didn't have time to completely back off after she cut in front of me. And believe me, I know I'm lucky she wasn't hurt, I've seen how ugly that situation can get.
 
maybe not, I'll have to find out tomorrow. I've just heard of a court fee or something similar in traffic cases, but could be completely wrong.
 
^it's usually included in the ticket. I haven't gotten a ticket in years but I never had to pay anything additional to fight one before.
 
Where was the damage to her vehicle? Was it square across the back, or on a certain corner? The reason I ask, I was in a similar accident. A woman pulled right out in front of me, and I had no time to stop. I hit the back passenger corner, since she hadn't even straightened out yet. It created a wedge in my truck.
She admitted to the cop that she didn't see me, and that she pulled out in front of me. However, when dealing with her insurance, she changed her story, and they tried to say I could have stopped. After proving that she hadn't straightened out (physics doesn't lie) and having the cop call the insurance company explaining what she told him, they admitted fault. Took some work, but I got it done.
So maybe draw up a diagram, (my police report came with one) that shows what happened.
 
I would definitely contest the ticket! Either way, added fees or not, at least you're doing something to stick up for yourself. I don't think you want that type of citation on your record either...

It is completely ridiculous when they hand out tickets after an accident - as if smashing up your vehicle isn't trouble enough.
