The court found that the dealership was negligent, but did not defraud the customer by intentionally billing for a service not performed. I expect the lawyer filed under the Motor Vehicle Service and Repair Act as a way to collect $70K in legal fees on top of $40K in damages, rather than taking fees out of the damages that would have been collected under a negligence suit.

Well, it is Michigan, so the expectation for car maintenance knowledge is far greater than it is for those people who move between Florida and New Jersey.
