You are all right...I actually deserve a good bashing so others that are thinking of giving peoples morals a chance will know that it can happen....so beat me up, please :lol:

I admit I made a stupid move but it was almost like a perfect storm and that it was meant to be so maybe something good will come out it...like a new motor at the seller expense!! I wanna paint a picture to somewhat justify myself but if it doesn't work I'll just say its for the benefit of future buyers that are thinking of following my path

The seller was a girl
she sounded completely honest
all the paperwork "seemed" to be in order
the weather was horrible and finding a shop that was open to look it over was out of the question
I like 4runners :biggrin2:
and the biggest reason...my tranny went out in my fronty 2 days before this storm and we live in the hills

For your entertainment I'll try to keep ya'll updated. I may just do a small claims scenario, has anyone ever been involved in one that may have some advice?

Hope you had a bill of sale stating it has the 3.4 or some kind of legal document. Sorry man always do your homework.

She told me she bought it off a professor from the university here and 2 weeks later the engine went bad...I didn't ask the specifics of what she meant by "went bad", and I took it more as an engine replacement, not a swap.

The title of course says 95 4runner...thats what it is. I see what your saying and yeah it'll be fun in court if she wants to go that far. She told me on the phone that the engine was replaced from a 98 and said she had all the receipts from it, which she gave me...they were notarized and everything...she could easily say to the judge that those weren't supposed to be in the pile with the other service records and that she never told me the engine had been replaced. Its out of my hands as to how a judge will rule.

Now, I believe in karma...however I put a twist on it in rare occasions such as these and feel that karma is calling on me to dish out equality, due its dirty deeds :biggrin2: I'm her huckleberry til this is resolved.

How long ago did you buy it? you could try to return it to her and keep looking for a 3rd gen. She might take it back if she didn't want to go to court over the error.

That's true, she probably had no idea, but she could go back to the guy that did the swap, lucky can't.

I got it last thursday, the 3rd. I don't necessarily want to return it, its still a great ride. Its just that I paid top dollar for what is looking like a bottom dollar vehicle. I would be some what content with a slight reimbursement based off of KBB. It was supposed to be a 95 in great condition with about 130k miles but if it turns out to have twice the mileage then I'd be happy with the difference. Does that sound fair?? It'd be better than court

I just got off the phone with her and told her my concerns and she is saying that I must be wrong. She says that she and her father personally took the vin from the 98 motor before it was installed and had the local yota dealership run it...verifying that it was indeed a 98.
I like to think I'm a decent judge of character and I'm getting the feeling that she may really believe her stance.
I'm heading to a buddies house to dig around and look for this vin and see if maybe it has some clues to it being a fake. Obviously there is a visual difference in a 3.0 vs 3.4, but the average person would be non the wiser.

Keep the opinions and advice coming guys...every bit helps

From the Haynes Manual:

"The engine identification number on V6 engines is also stamped onto a pad on the left side of the engine block, above the oil filter cartridge".

EDIT: Note - "left side" = "drivers side"

Thanks realtor!! One of the kiddos got sick so I wasn't able to get after it last night and with 22" of snow on top of it this morning todays not looking real good either :wtf:
