Changing the price?

First time poster, (fairly) long time reader. Great information on this board, you guys helped me so much to decide on buying a new car.

I purchased a 2007 SE 4runner several weeks ago from a dealership. The dealer at that time made a mistake, they gave me both the 0.0% APR and the $1,800 rebate. I didn't notice it when we were doing the paperwork and wouldn't have thought anything of it until they called me and said that I needed to come in and redo the paperwork, essentially adding $1,800 to the price. What I'm curious about is whether or not this is legal. They were unwilling to make any type of amends or compromises and said that if I was unhappy with the deal they'd take the car back. I had thought that the price was final once the papers were signed. Apparently not. If this doesn't make that much sense it's probably because my hands are shaking, I'm still so upset. What do you folks think, am I in the wrong or should the dealership eat their mistake?

I'm not a lawyer, but if the contract (that long-ass paper that you signed) has both of those term in writing and you and the dealer both acknowledged it... I'd say tell the stealer to "go to hell" or "see you in court."
 
I would'nt change anything. I would tell them it is there mistake and to take it to court i am sure they would just leave it at that i had this happen to me at a chevy dealer before and they just ended up eating there mistake let they are just trying to scare u to get u to pay it so they do not have to eat it good luck

Ever played monopoly and had a bank error in your favor?

They charge hundred of dollars in "documenting fees" (charging you to buy something from them?)
Tell them to complain to whoever handles their paperwork, and you shouldn't pay a dime more.
 
I'm so glad that you guys feel the same way I do about it. I was worried for a bit that I was wrong to feel that way.

For what it's worth I called Toyota financing and another dealership. Toyota said that as long as the contract has been signed there's not much that they can do. And the other dealership said that as long as I didn't sign a rebate form (which I didn't) that they really don't have a leg to stand on.

The hard part for me will be to call them up and telling them to get bent. I hate that sort of thing.

Tell them to come get it, and why they are at it to bring your trade back, if you had one. I'll bet a dollar to a doughnut they can't. I think it would be worth a call to an attorney so you know where you stand legally. At the end of the day it's a civil matter anyway and it will cost them more to fight you than it's worth. I would also plan on finding another dealer for warranty and service work.

why would you even call them back? let them call you, and when they do tell them you're busy. Really, there is nothing that they can do. Just like there would be nothing that you could do if you realized a week after the purchase that it was not in your favor.
 
I agree with everyone. This is their problem not yours. But don't ever go back there for service. Find another dealer for that.

The deal is final and they can't do anything. What happen to "No Cooling Off period"??? They might threaten you , but tell them to eat it!
 
Don't bother with it. Its a written contract. Thats like me going back after a few weeks and saying I could have bought this 500 cheaper if I would have just done my homework on Edmonds , lets re-write the contract for 500 cheaper............. how much success to you think you would have with that ?

Ask them that question !
 
That contract (binding document) is an agreement meaning they agree to sell and you agree to buy at the listed price and terms.

Its all just a "come-on" Its another way they can get your more of your money, also tell them youll agree to re do the contract if they decrease the price even more.

I would report them to the BBB just for trying such a sleezy tactic. They should just be happy the got the sale. And think of the service revenue they will be missing by you (hopefully) going somewhere else to service your vehicle.

Just out of curiousity, where do you live?

Yeah! I love it. The dealer is trying to recoup some losses. After years of sticking it to all the innocent folks too timid to negotiate a solid deal or stand up for themselves, Goliath falls! Tell them you'll come back in with a pound of sand.

Please give us an update.


BTW, congrats on the new 4Runner. It might be a good idea to have it serviced elsewhere.. lol
 
Hope it was Michaels toyota because they got me the opposite way. We shook hands on one deal and when it was all said and done I paid more. So I hope you just don't even think of giving any money back. Because believe me if it was the other way around they'd just try to talk you into or convince you of what a good deal you got even though it was not what you thought it was.
 
Here's where we stand, I had initially left it with them that I'd come in to the dealership and talk. I did my research and realized that the whole thing was fishy and said to hell with them and didn't drive out there or call them back.

The dealer eventually called me back and wanted to know when I was coming in. I told them that I had no intention of doing so and that they shouldn't wait for me. That was two days ago. I'm in Northern VA and haven't had any 703 area code numbers call here. So I guess they've given up?

I'm still anxious because when I did talk to them earlier they said that I hadn't canceled my extended warranty. There's more to this story. When I initially purchased the vehicle I took the extended warranty they offered ($1800 for some third party deal-it was refundable if you didn't use it...) I went in maybe a week ago and canceled it. When they first called me it seemed like they had no knowledge of that. Which feels so much more slimy. The more I think about it the less sympathetic I am for them. I guess I'll have to call them back at some point and see what the deal is with the warranty. I'd much rather get a real one from Sean for half that price.

I'm just worried that they haven't called me back and tried any of their tricks. It makes me wonder what they're cooking up. But as you all have pointed out they don't have a leg to stand on. The contract is final, and even Toyota headquarters has said the same.

Those of you who have said that I shouldn't go back for service make a great point. There's no way after essentially screwing them that I could go back in and have them work on my car. They'd kill the poor thing.

I'm surprised that no one had anything to say on the side of the dealer. I had half expected at least one person to be on their side. But I guess I shouldn't underestimate the animosity that car dealerships have created in this country. It's brutal.
 
I consider myself a very honest person and always try to be fair. In my particular case the bottom line from the last people at the dealership I talked to while trying to resolve my situation was quote: "you signed the papers and you wrote the check" which in fact I did after much protest, so all in all the same could be said of them in your case. Guess if I had felt I had not been "screwed over" I might have felt like siding with your dealer had it all been on the up and up, but there's no way of knowing that in your case. However, car dealers do NOT have the best reputations for honestly.
