deposit down for 2015 model, now dealer says can't find one, needs more $

I negotiated for a 2015 Toyota 4runner Trail Premium with KDSS and no other non standard options for 38500 and put down a deposit for this vehicle. They told me they will find one.

Now they are saying that the one they had an eye on has a deposit on it somewhere else, but there are other 2015 models with more options on it, which will be more expensive they say

another option they said would be for them to build me a new 2016 model with the options I want, which would also be more expensive. Their "well it has more resale value" advice doesn't apply because I plan on keeping this car for it's entire lifespan.

I'm kind of aggravated at the situation, and I signed an agreement with a deposit for the car I want at the price that was negotiated... but I understand if that car simply doesn't exist, I can't get it either way.

From this point, I feel like my options are:

1. Pay more for 2015 model with more options (that I don't want)
2. Pay more for a 2016 model

or

3. Figure out a negotiating tactic to get either option 1 or 2 at the price I already agreed on (best case scenario if I can't get the vehicle I want).

I know there is more pressure at the end of the month to make a sale, and I know they really don't want to let go of that deposit.

I'm in no rush to get this car so I can wait a month no problem. They said they will keep looking and call me back next week.

I haven't spoken to them about me knowing about the hold back of the vehicle so I can use this as a negotiation tactic.

Some other Ideas I have

1. Wait till end of the month
2. Threaten to write bad reviews everywhere if deal falls through OR write good reviews if they accept my deal
3. Something else I missed?

I know before you were debating about Trail vs. SR5. I wanted a Trail too but honesty it was just because I think they're cooler than the SR5. Ultimately an SR5 Premium was more practical for me and I got mine at what I think was a great price. Not to complicate your position but is it worth revisiting the SR5 plan again?
 
Your the Customer

If you have time get what you want. Don't let the dealer pressure you into options you don't want/need. Get your deposit back, you are the customer, do not get pushed around for a single moment. Luckily my neighbor is my salesman so I have a solid source and great pricing. The models are out there the salesman just has to do some leg work. Try using TrueCar (my salesman hates it but he admits it makes him more competitive on the price right out of the gate) Also if you are looking for a specific model color like I was (White TP w/KDSS no options, not even floor mats) focus on the Internet reps for dealerships they are used to the hunt. All else fails teach them a lesson with your wallet. If you want to fly to Chicago I think my dealership in the suburbs still has a TP KDSS headed their way in September (near OHare ;))

P.S. My dealership found the exact on I wanted in 3 days, had it transferred in less than a week, brought them my 2011 SR5 over lunch and i was out the door.
 
How much more is Option 1 and Option 2? I can't imagine if you order the exact same spec as a 2016 compared with the one that you were looking to get as a 2015 that it would be significantly more.
 
They breached the deal...so...

im sure they expect you to just relent and pay more, so that you meet THEIR needs...i say, pull that agreement, say they breached it...gimme my chedder back...and patently go find the truck you want, not the truck you'll settle for

tell them to kiss your ass. a 16 shouldn't cost anymore unless they're giving you some stupid end of model year deal.

toyota dealers are the absolute ****ing worst
 
Bait and switch

I am not a lawyer, but to me you are the victim of famous "bait and switch" tactics.
From Wikipedia:
"In the United States, courts have held that the purveyor using a bait-and-switch operation may be subject to a lawsuit by customers for false advertising,"

Start searching on the net for the one you want and when you find one on the lot talk with the internet sales person and deal with them on the price. I am sure that you find one you want at a good price if you look around within a couple hours radius. Good luck
 
I also have a deposit down on a trail premium w/kdss. I am very interested in how this plays out. Keep us posted, I am taking delivery (fingers crossed) 1st week in September.
 
or you may just get your money back, wash your hands of them and find another T4R of your liking locally or within flying distance if the price is right.

EDIT: So, I retract my statements after "reading the rest of the details"

Been reading up on your posts. I'm going to "let them keep looking and working with dealers" the sales rep told me today when I called that he will call me back within a few days with an update on what's going on.

When I was signing the purchase order and doing the deposit, we went over a 120 day policy that if they can't give me that particular car, they have to build one. Otherwise, there is a "no refund on of deposit" next to the $1000 dollar deposit number I gave them.

Obviously I don't want to wait four months for a car, but if that's what it takes to get a 2016, oh well. (I doubt it will take that long)

That being said, I don't know if I can just walk in and say "gimme my money back"

I live in CT, I don't know the laws 100%, and this is my first time buying a car, so I may have screwed myself, but I'll give them some time for now to "find the vehicle". Thank you all for your help.

Or you can get a SR5 install Icon suspension, wheels of your choice, and tires.
You will have unique personalized rig, and call it a day.
 
They owe you your deposit back plus interest. After all they did waste your time. Once you get it - run like the wind! Even if they find you the 4runner you want - can you trust them for the future?
 
You're obviously skeptical of these guys and rightly so . Why would you want to continue any kind of relationship with them ? Get your money back and go to the next Toyota dealer down the street . There is no way they are going to cut any deals that are going to be advantageous to you ...
 
Trail Edition Premium options and price

Did they put the VIN # on the contract? For my order and deposit I have that in writing along with the price for my Trail Edition. It took them a few days to confirm they could get it before I had a firm quote. I had faith in them and it worked out fine. It may be that if you didn't have a contract for a specific vehicle, they have an out. That allows them to offer something else for a fair price, even if it is more.

Your best choice is to get your deposit back and tell them you'll gladly make the same deal if they can find the one you want, or a better price on one with a few more accessories. Forget about threatening to sue or smear their name all over the internet in an attempt to destroy their good will. It won't get you anything and you may need their service later. They would likely give you your deposit and ask you not to come back. Take the high road.

All of the Premium models come with lots of accessories. Good luck finding one without several options. Try a search through Edmonds, TrueCar, Costco or cars.com for the model you want. While you're at it look for any Trail Edition Premium. See what options they come with. In June I wanted a Trail Edition with KDSS but without any other options or accessories and had to order it through Toyota. They built it for me and it's on it's way to me now.

It's too late to order a 2015 from Japan, as you may know already. Plus there are no more 2015 4Runners being built now, according to one dealer I spoke with this week. Whatever you can find for sale anywhere is all there is.

You have plenty of time to order a 2016 but time is running out on 2015 models. Ask them if they have the MSRP and invoice price for a 2016 model in writing. Chances are they don't. Ask them when it would be delivered. Typical order to delivery time is 8 to 12 weeks.

The next production run and shipment will be 2016 models. Prices for 2016 should be very similar. And you could order a 2016 exactly the way you want it right now. You could wait to see the MSRP and Invoice price in writing from Toyota when it's confirmed before agreeing on a price. The deposit should be refundable for any reason at all. The 2016 models won't hit the dealers lots until late October or November, if last year is any indication.
 
What they are trying to do is lock you in further. They took your deposit based on a specific vehicle, now they cannot find it. There is probably one sitting on another lot, but the other dealership will not let it go. Go online and find what you want. If you stay with this dealership, only let them keep your deposit if they give you the vehicle VIN, options list and "no later than" delivery date.

This "almost" happened to me. Dealership A wanted a deposit on a very specific 15 Limited but could not give me a VIN or mileage etc. I countered with a deposit "if" they could provide the specifics mentioned. Finally realized that they did not have my exact vehicle located yet when they called asking if I would accept option XYZ.

I went online, found a dealer with one (actually was being unloaded when I called), and discussed price before I made the drive. By the time we arrived it was prepped and we were the first to drive it. Bought it for previously agreed on price. Called dealership A back and thanked them for their time.
 
My .02 is you give them two options:

1-Find me what I want for the agreed upon price
2-Walk

I also had put down a deposit for a 4R and the dealership even gave me a VIN, I signed paperwork, and said I would be back in 4 days because I was going away. 4 days later the slimeball salesman texts/calls me and says there is a problem and they could get me a different color. I told him I will be at the dealership in 6 hours for my money or my truck, his choice. I showed up and he had a black 14 LE with more options waiting for me. I did not pay for any of those extra options on the truck.

Hold your ground.
