A Toy Yoda.....

hahaahahahaha. Come on girl, it was a joke......get it toy Yoda.....what da ya mean lawsuit?

A gag joke being taken as a contract????? She might just get it. They probably did say winner would get a "Toyota" knowing that they would only award the winner with a gag gift. All management was in on the joke...but the terms of the contract was fulfilled. They offered the beer sales winner a prize. She accepted their terms of the offer by her work and winning the sales event. Unilateral contract. Offer, consideration, and accetance. And performance. Would not take a first year law student to win this one.

Then of course you can imagine the shock her face when they led her to the toy Yoda amidst all the laughing and giggling.....I would no have problem with Hooters if they gave her the toy Yoda and afte the initial shock of the gag gist, have her open the gift to find hte keys to a real Toyota parked in the parking lot. Not only would it have avoided a major embarassment, but it would really motivate other employees in other contests as well. But Hooters thought they were so smart and slcik, lete's make fun of the poor winner....and laugh at her as the look of shcok and betrayal and shame goes to her face....let's see intentional inflction of emoitonal distress, neligent infliciton of emotional distress, "hostile work enviroment" after she complained.........poor little waitress being embarassed and humuliated as a gag joke by a restaurant chain known to exploit waitresses.......

Yeah, I could see a good on for this. If I were Hooter's legal counsel, I'd say give her a nice Sequioa and have her sign off a no fault agreement and FIRE the stupid SOB who thought this was funny.
 
if she wins the lawsuit, they could possibly just get away with giving her one of these:

So we lied about a "toy Yoda". but we're straight now. A real honest to goodness Toyota vehicle. It even has power lift adjustable ride height...hahahahahahahaa....and full open convertible feel......carries several hundred pound paylod, run flat tires...(hahahahahaha wiping away tear....:jump: direct in line steering, very, very firm suspsension, low to the ground effects, :flipoff: and low emissions....hahahahahahahahaha

Sorry folks, just a bit of corproate humor....yes the Hooters is really for Hootie the OWl and not for the jiggling mammaries yo usee on every waitress...and no the skimpy tight shorts have nothing to do with being a sexist semi TA bar...no ma'am we don't need a picketing by NOW.......Now listen here, just because we do no have one single solitary male employee does not mean we're sexists. we have....we have....Juan and Jose in the kitchen washing dishes. Yes they are male so there. So we could not find any male applicants to be waiters that had 34DD breasts and look good in tight shorts, that's why......

This is an OLD story from 2001... she went to court and WON the lawsuit in 2002! Sure it cost hooters the price of a new car, but talk about cheap publicity!

Unbelievable folks. This is an update to the waitress who thought she won a new Toyota vehicle. SHE WON the lawsuit! They settled. Jodee Berry, 27, will now get to pick the car of her dreams. I bet she picks a Rav4.

I cannot believe a judge fell for this. I cannot believe that people cannot take a joke anymore. I bet I will get sued for making these statements. It gets more difficult to have fun in this world. Lighten up. Take your yota and get lost, Jodee.

A waitress sued a Hooters restaurant franchisee Gulf Coast Wings, Inc. because they gave her a toy Yoda doll as a contest prize instead of the Toyota car she was expecting. Jodee Berry won a contest to see who could sell the most beer at the Hooters in Panama City Beach.

She said the top-selling waitresses from each Hooters restaurant in the area were entered into a drawing to win a Toyota. Being the top seller, she believed she'd won a new car.

She was blindfolded and led to the parking lot, but when her blindfold was removed she found she was not the winner of a Toyota, but a toy Yoda doll from the "Star Wars" movies. Jodee didn't take the joke too well. After the stunt, Berry quit the restaurant and filed a lawsuit alleging breach of contract and fraudulent misrepresentation.

The former Hooters waitress here settled her lawsuit and can now, according to her lawyer, "pick out whatever type of Toyota she wants,"

The restaurant's manager said the whole contest was just an April Fools' joke.

I wonder who's laughing now.

New Toyota to replace toy Yoda

PANAMA CITY - A former waitress has settled a lawsuit against Hooters, which she said promised to award her a new Toyota but instead gave her a toy Yoda.

David Noll, an attorney for Jodee Berry, said Wednesday that he could not immediately disclose the settlement's details. He did say that Berry can now go to a local car dealership and "pick out whatever type of Toyota she wants."

Berry, 27, won a beer sales contest last May at the Panama City Beach Hooters. She believed she had won a new Toyota car.

She was blindfolded and led to the restaurant parking lot, but when the blindfold was removed, she found she was the winner of a toy Yoda Star Wars doll.

Berry quit the restaurant a week later and filed a lawsuit in August against Gulf Coast Wings Inc., the corporate owner of the local Hooters. The lawsuit alleged breach of contract and fraudulent misrepresentation.

The restaurant's manager, Jared Blair, said the contest was an April Fools' joke.

This settlement is unusual in that Hooters did not ask for a sweeping confidentiality agreement, Noll said.

"I think that's a recognition of the fact that there's been such an amazing amount of attention focused on this case," he said. "There's not a whole lot of reason to try to hide its existence."

Glad to see she got a new Toyota, if she got her choice she would be nuts not to get a new Landcruiser. Hooters is old new's, bad food and ugly girls.

Is it any Toyota even their upscale counterpart, I would get a LandCrusier with an SC and every available OEM addon possible
