Frame rot? Not sure what to do.

I'm not a "car" guy- I'm more of a motorcycle guy (I'm JustRon on advrider.com and ThumperTalk). However, I just bought a 2004 V8 Sport with 70k miles, and really love (er, loved) it. It appeared to be in great condition and drove excellent.

In a week, I took it on two road trips (currently in VT), and around 800 miles, I hit a small bump and heard a klunk. Looked underneath, and didn't see anything odd. Then, heard another one a few miles later, and it seemed to pull to the right. Then, I hit the brakes going about 5 mph, and it stopped- wouldn't move and the tranny did nothing. The tow truck driver said the control arm broke and took it to a local mechanic. The mechanic said the control arm didn't break... it ripped out of the frame! He didn't put it on a lift, but he said he won't touch it. He's worried that there are other frame problems lurking beneath the undercoat (courtesy of the previous owner). He doesn't want to be liable if the frame falls apart while I'm cruising down the highway. He said, I'd never put my wife or kid in that thing. Great.

I couldn't figure out what to do, so I called my insurance company- Progressive. They sent an adjuster and he estimated the parts to be around $350 (which seemed really low to me), but said they aren't' covering any frame damage. I called another mechanic and although he didn't see it, he said he won't touch a frame on an '04 4R. I said, no, that's the Tacoma with the frame problems, but he sorta disagreed and said he's seen enough bad 4R's that he doesn't want to get involved. He said to sell it to a salvage yard. Ugh.

It's currently in Stowe, Vt and I'm in NYC. I'm going to call some more shops tomorrow, but am worried that no one will want to work on it.
So, even though the insurable damage is only $350, if no one will fix it- I'm not sure what to do.

I can't imagine Toyota is going to help out with this. They said the VIN doesn't fall into the range of any frame-rot affected vehicles. The crazy thing is, the body hasn't been painted, and there's no rust anywhere.

My family thinks I should go after the seller (I bought it on craigslist... I've done it many times with bikes, but like I said, I'm not a car guy). I specifically asked him about rust (because it had VT plates and he lived in NYC). He said they had it undercoated and always sprayed underneath to keep it clean. I have an email from him where he says "no rust". I figured he probably didn't know, but everyone else thinks he's lying and had it undercoated to hide the rust. That would be pretty tough to prove, but by saying there's no rust, I guess that's a serious misrepresentation.

Aside from the things I've already done wrong, which can't be undone... what would you do now? Any advice? This sucks because I really liked it. But, my gf said she would never feel safe in it again, due to what the first two mechanics have said.

Pics? I've seen this happen on 3rd gens, but I think you are the first 4th gen guy to have a control arm bracket snap off. Are you also sure that the mileage is accurate? Odds are that he knew about the rust and used the undercoating talk as a way to make you believe he took care of it. You may need to check state laws regarding used vehicles sales. He did falsely advertise it as rust free, but it is an 11 year old vehicle after all.
 
Unfortunately, no pics. However, when I looked underneath (before I bought it), my very untrained eye thought it looked good. Obviously, the undercoating is covering everything, which is why it looked good.

I asked the insurance guy how it passed VT inspection in Feb (because I heard VT is pretty tough with inspections), and he said they only do a visual inspection. They may not have seen any rot if it were below the undercoating.
Based on the CarFax, I think the mileage is correct. Plus, it's a one-owner vehicle. (The CarFax is really clean, from what I see...)

Also, it really looked like it had low miles- very little wear. I guess that's why I'm so shocked that the frame could be rotted.
 
The mileage is believable. IMO, the problem is that it's from Vermont. There's rust, then there's Vermont rust.

As for the VT rust... I would have expected there to be rust somewhere on the body, or wheel wells, or sun roof, but I saw none. Also, I'm not sure if the guy just had it registered in VT (much cheaper than NYC) and it may have been parked in NYC. He wasn't clear about that, and I didn't ask enough questions. Although, NYC is also hell on cars.
 
Just a suggestion. You need to provide pixs of the rust so others to provide you with helpful ideas.
 
Unfortunately, I think you are looking at a total loss or doing a frame swap. You could sell off all the good parts to make up some of the loss. If your leaning towards a frame swap, I would try to find a frame from the southwest. We have very little rust issues here. If you're thinking of just replacing the 4runner with another, I would also recommend finding one from the southwest.

Sucks to see you in this situation. Don't bother with mechanics, they'll all send you packing. Try a body shop that does frame repair and see what they say about it but it's probable you got screwed by the cover-up the seller did. You do have recourse in the courts but that can get expensive.

Wow that looks nasty. Glad no one got injured. 2nd the frame shop.
 
Yikes! I wouldn't waste another cent on it. Looking at those pictures, I could only imagine what the rest of it looks like. If you have rusted through the mounts which are some pretty stout parts, the guy did you a favor by not putting it on a lift. It won't only be the frame that will need to be replaced. Pretty much everything that is steel will need it. Undoubtedly the previous owner knew it was rusted out. I am sure everyone in VT knows about rust. They should have told you. I would feel guilty if I did that to someone.

If I were in your situation, I would either part it out if you have the time and patience or sell it to a salvage yard. The only way you can even come close to getting your money back would be to part it out. With only 70K, you would have no problem selling the motor, trans, 4wd parts, etc. The interior parts would probably go easy as well since they should have minimal wear.

Before I did anything, I would call the original owner and have a chat. If they have a heart and a conscious, they may take it back. I know I couldn't do something like that and sleep at night. If the undercoating is fresh, they undoubtedly did that to cover it up. Maybe worth legal action.
 
The owner (technically, son of the owners) doesn't answer my calls or texts now.
I'm trying to find welders in VT, but it's tough being so far away from the car. I can't really afford to keep towing it from place to place.
As for parting it out- I don't know how I could manage that, living in an apt in NYC.

You may be out of luck on this one. I wouldn't spend time trying to find a welder, there's nothing to weld to. Looks to me like it's all rust. If the body, interior, motor are all in excellent condition, I would try to find a shop willing to swap to a better frame. Other than that, get all you can out of the insurance and find something else.

Insurance isn't paying anything, because the frame rot was caused by the previous owner (essentially- I only owned it for a week).

I asked Toyota for a quote for a frame swap, but I assume it will be laughable. Is a frame swap something do at a non-dealer?

Edit... just did a search for frames, and they are cheaper than I expected (PartsHotlines)

If I went that route... any suggestions for a shop in VT that could do this work? Assuming it's not too expensive.

Please file a safety complaint with NHTSA. There are already a number of complaints about rusted out frames on the 4th gen 4Runner. If NHTSA receives enough complaints, Toyota may start a frame replacement campaign like they did with the Tundra and Tacoma, or NHTSA may force/order Toyota to do the frame replacements. I believe that Tundra/Tacoma owners who repaired/replaced their frames before Toyota's service campaign were reimbursed, but I'm not sure.
