People are stupid.

Mistake #1: Meeting location not a very public place

Mistake #2: Meeting inside car out of sight of public

Mistake #3: Going to location alone not bringing buddy

Mistake #4: Not being armed

Mistake#5: Letting the perp walk away... then pulling a u turn and running him down...


Once he let the guy walk away and get out of his vehicle the self defense justification went out the window... Once he drove away and returned looking for vengeance he is now going to be guilty of attempted murder/ manslaughter and a whole host of other charges... Very poor decision making on the seller's part. Too bad he was probably an innocent person who just made really bad decisions that will now alter his life permanently...

i don't disagree that the seller made a very poor choice as far as course of action.

how do you feel about the armed robbery?

Well, don't forget that he has 3 kids at home too....
 
I hope the driver doesn't get much time, if any. If I was on that jury, you couldn't get me to convict him. Although the most damning part(aside from the gruesome nature) of the video is his approach speed. He's FLYING at the kid, clearly out for blood. No other way to spin it.

I don't know what my reaction to having just had a gun pointed at me or robbed would be, but I can't say for sure it would be much different than his.

Attempted 2nd degree murder would be the charge against driver. No premeditation, but certainly an intent to kill. Not sure about NY definitions, so the actual charge would be different. He's using lethal force to protect/regain his tangible property, and there is almost not excuse for that in NY or anywhere else in the US (law is different in each state folks, don't get mad at me, just the way it is in NY. I seriously doubt you'd get away with his actions in a stand your ground state either especially since the kid is leaving and no longer posing a threat). I say "tangible" property, because if someone has broken into your house ("real" property) in some states that alone could justify the use of lethal force ...you're going to be hard pressed to find a jurisdiction that says its ok to use lethal force to protect a "thing" aka "chattel" (I'm almost certain none exist).

The kid should go to jail for the robbery, but the driver should also go to jail for using lethal force to regain his stolen sneakers (it was no longer self defense once the kid walked away as mentioned earlier). They both exhibited extremely poor judgment.

Your are right of course. But the driver has very wisely said he was shaky, just wanted to get out of the area and while simultaneously trying to U turn, call 911 and operate his vehicle he unintentionally lost control and hit the robber. It's the burden of the prosecution to prove otherwise. He stopped at the scene which buffets the claim that it was an accident.
