As a photographer, I think ICON would have a better case if they argued it from the photo copyright infringement aspect:

That's a pretty uncanny resemblance.

Copyright laws are hard to enforce. The original image would have needed a © and even better registered. As a photographer myself I don't have time to register with the government all the images I take. Altho mattel has deep pockets and I'm surprised they would rip off an image like that without compensation.
