That's coming out of his pocket. Insurance doesn't pay for intentional acts. My suggestion if it were in TN is to let your insurance company fix it and then let them go after him to recover. You'd be out your deductible until his insurance company denies coverage, then it would fall under uninsured motorist and down here, your insurance company would probably reimburse the deductible at that point. Can't say how it works in your state, though.

I hope you see the criminal charges through and that he loses his license. Guy needs to be off the roads permanently.

Hopefully MT Runner has uninsured / underinsured coverage. I've always been asked if I wanted it (and always gotten it). The deductible being repaid to the claimant may be a state-by-state thing. I know I had to make an uninsured claim before because the douche that ran in to my previous wife wasn't insured. We paid the deductible, they fixed the car, and went after him for whatever they could recover.
I assume you could sue him for your losses, such as from work, deductible, any hardship suffered, mental anguish as you knew your wife was next to the vehicle, and didn't know if she was going to be injured, etc.

What a nightmare for you.

I have heard such horror stories about WY and MT that it's almost enough to keep me in CO and UT, where the water has excellent public access and there aren't fences across every river. I've heard that on the North Platte in WY on certain sections you can't even put your feet down between the tubes of your cat. WY has some f-ed up laws that favor private landowners.

All of it is strange to us; as NYers, we are not tresspassing unless we are above the high water mark. What happened to you is different because it was at a launch, but I just can't see a private land owner here getting so revved up.

We are planning a MT trip for next year, floating for 2 weeks. Is it hostile at a lot of access points, in your opinion? Makes me nervous...

Really nice cat, by the way. I really wanted a red one when we bought ours but NRS only had blue that year.

I did get my 4Runner back last week. Everything looks as good as new, you can't tell anything had happened.
We are still in the middle of the situation so I probably shouldn't post too much about it. Basically we're being told that the county attorney is pressing charges that amount to a couple of misdemeanor traffic violations, nothing about criminal charges. They are doing that under the guise of that being the best way for us to get our money out of the guy and his insurance. We are still going to be meeting with our attorney to check on our options, see how much it's going to be worth to go after him in a civil case.

Catskills4Runner, As far as the public access in MT goes, I've never had any issues before so I wouldn't say it's anything to worry too much about and avoid coming here because of it. I've primarily stayed on the rivers in south central MT. The Yellowstone, Stillwater, Bighorn, Boulder, and Madison are the main rivers we're on each summer. The Boulder is the only one that we've run across some crazy people. They're not too fond of recreationists around there(as you can see). The river laws here are the same that you had mentioned in NY, the high water mark is state land, anything above that is going to be trespassing in most areas. I've heard WY has stricter laws on that, but I tend not to make it down there much, except to drive through, so I can't speak too much to that.
Thanks for the compliment on the cat, it's actually relatively old and worn out so we've been looking at upgrading to a new one soon, same thing, just new tubes and frame. Depending on what happens with this situation, we'll probably use the money we get to buy a new cat, kind of a nice "f you" to this land owner and the whole situation.

that's BS and none of the county attorney's business. if the county gets a criminal conviction, your civil suit is a mere formality - the criminal burden of proof is higher than a civil burden. money is your problem, nobody else's, and especially not the county attorney's.

call the MT Attorney General and get them involved. if the county attorney is appointed, find out who appointed him, and start yelling at them. you have a right as a MT citizen to have the state and the county work for you. make sure the governor's office knows about this. you are a MT resident, but MT wants and needs tourist dollars, and deranged locals smashing into trucks along the river are bad for tourism. put some pressure on the county attorney to do the right thing.

get a restraining order against the rancher. he'll blow his stack for sure.

Not telling you what to do, but if it were me I would tell the DA I don't give two shits about the money. I want that lunatic behind bars for as long as we can put him there so he doesn't kill someone with his madness. I wonder if you could pursue a Psyche evaluation and get him admitted? I agree with these two points, the County Attorney is looking for an easy win to add to their resume, your best interest is second if that... Everyone has a boss, go to the AG and make a stink. Just my $.02, back in my lane now.
