So....i had missed the green arrow so i naturally pulled up a little bit to the middle of the intersection so i could yield on green and wait for traffic to clear or the light to start to turn red so i could turn...the traffic on the oncoming side in the lane closest to the curb had stopped but the was still green and it was clear so i decided to go and i went the light had turned yellow then out of no where this dude comes out of no where and t-bones me......He told the cop that he speeded up to beat the light i get the f'n ticket!! Im pretty sure what i did EVERY SINGLE DRIVER DOES!!

So......who do you guys think is at fault??

What you did was illegal.

He is legally allowed to try to make the light, you are not legally entitled to swing turn at yellow, when you do not have a protected light and not get the ticket.

Until the light is red, that lane is 1st priority the oncoming traffic. Without a protected green arrow, you have 2nd priority and have the right to turn when no oncoming traffic is in the way.

Simply put. Sorry, that sucks, but it is your fault. He shouldn't have tried to beat the light, but you are MORE wrong for taking HIS lane.
 
Sorry that happened man, never fun to see a dent in your baby! I can't tell exactly what happened from your description of events, but even though alot of people do that, I'm pretty sure it's illegal.

On another note, you should post pics for maximum sympathy :)
 
Just because you think that "EVERY SINGLE DRIVER DOES" it doesn't make it right. You turned into oncoming traffic, your fault! Next time instead of inching your way into the intersection trying to get the oncoming traffic to stop have a little patience and wait for the light.
 
i never said inched into the intersection to "get traffic to stop" i was still on my side of the road as i was waiting
 
That is semantic. There was a collision because you obviously entered his lane. Whether you inched or not isn't at issue.

Accept what you did as wrong and learn from it.
 
oh i figured its my fault...i just wanted to here opinions...but still...ya kno...he could have stopped and the part that pisses me off the most is that he didn't get a ticket
 
The purpose of law is to order the interactions of any system with more than 1 person.

Driving laws have to, at somepoint, take a harsh up and down line to prevent any wiggle room. A cop has to pick. If the legal system doesn't pick, then insurance doesn't function well.

He didn't see you were turning. The exact reason for this was you turned when you shouldn't and he didn't have sufficient time to stop.

Thank GOD no one was hurt. In future, maybe don't do this. T-Bones can be deadly.
 
So they guy admitted to speeding up at the yellow light? Who's to say the light didn't turn red before he hit you. I guess you could have waited till the light turned red and cleared the intersection, but since he admitted to speeding up I think I would put him at fault.

Also, I don't know if it matters in this case but the guy could have been speeding when he hit you, that extra 10 mph to beat the light could have caused the accident too. But as others said, definitely don't trust other drivers and only turn when it's not a question or "hope he stops."
 
JNA4runner....you kinda give me some hope that could turn around for me...i understand that i entered his lane but still....he attempted to blow a red light if he speeded up when he saw the yellow..obviously he was at enough distance to also stop

i wasn't hoping he would stop....it was clear when i started to pull away..other wise..i wouldn't have went

It wasn't clear...otherwise the wreck wouldn't have happened.
Sucks that it happened, but cars can be fixed. Yes you are 100% at fault. Not a big deal, happens all the time. If and only if the insurance companies could prove the other guys was speeding (99% of the time they can't) he might be partially at fault, but you are still the proximate cause, therefore "at fault"...state laws are all different, but your insurance will end up handling his damage and yours assuming you have Collision coverage. Good luck! Be sure to pick a shop that give you a lifetime warranty on those repairs.
 
Most Toyota dealerships won't even offer a body shop. They will "refer" you to a local body shop, but oddly enough Toyota will not stand behind the shop's work that they refered you too.
Do what you like, but you are much better off picking a body shop with a good reputation that will give you a lifetime warranty. Body shops fix wrecked cars. Dealerships do not. If the dealership does offer a body shop, it likly is because the dealership had a need for one, which again is not where you want to be. Good luck. Hope it all works out for you!
