Just got this back from him:

Listen, i aint no dealer or was acting like a dealer... I helped family and that was it, i dont know who or even care who u talked too, i did nothing wrong. With this being all said I did contact my lawyer and he said if there is any more problems or if this does go to a legal matter that we will do a counter lawsuit against you and your lawyer I already advised my lawyer of everything that went on and he told me I did not commit anything that was illegal so if that's how you want to take it I'll see you in court and you could expect the counter lawsuit

So he is going to counter suit for u simply gathering information that indicates fraud.

If I sold a vehicle and I knew for a fact that I did nothing wrong—I would not contact a lawyer. I would not even be worried at all. If I was later contacted by the authorities or whoever, I would still not call a lawyer. Only if charges were actualy pressed or I was being sued—would I contact a lawyer.

Now if I was guilty—I would tell my accuser that I am in contact with my lawyer so as to appear as if I'm in a much better position than I really am.

It's like a fight—if I see my opponent smile, I know he is affraid.

I Think this ******* is running out of fresh underware right about now.

your best bet is to completely stop personal communication with him now. Any communication from this point forward should be from your attorney only. Then, he might get the picture.

once he gets an official letter from your attorney, his attitude will likely change. as he will then know you are quite serious.
 
I feel like I'm watching some sort of crime drama reading this thread. Except that it's not and it's actually reality for you.

I know that here in California if you get caught rolling back the odometer you are arrested, period. They don't mess around with that here.

dude the same thing happened to me in fl. I called the cops. Turns out after searching his phone number on craigslist he had a bunch of low millage cars for sale.
Long story short.
We were able to prove a case ( the cops wanted no part of it til my wife did all the detective work for them). They arrested him and charged him with 3 crimes.
1. Odometer fraud.
2. Acting as a dealer but not having a dealer licence.
3. Grand theft, for not paying the sales tax when he bought it form the original owner.

Because he had no record they offered him a deal, probation plus restitution.
It took over a year but about 5 months ago i started receiving a check in the mail from the florida dept of corrections for $163.00. He has 18 total total payments to make. So far he has made the first 5.

I cant believe our justice system actually worked in this case. My tax dollars did not have to pay for his room and board at the free motel, and i will hopefully get paid back the 3k i lost to the odometer fraud.

I too felt like the dumbest guy on the planet. Before this i had bought and sold a few cars on craigslist with no problems. I used to think i was a pretty good judge of character too. This guy totally fooled me. He had a lie thought up for every question and would tell it to me while looking me in the eye and with a smile on his face.
I too had a carfax but i was looking at on my phone and did not catch the date the millage stop being recorded. If i had of taken a closer look it showed only 10k miles in the last 5 years.

Be sure to screen shot all messages and interactions with him as well for documentation in case it comes down to needing it all.
 
Holy cow! I was wondering what happened with your transaction cause I never heard back from you after the carfax. I figured all was well! I just stumbled onto this thread during an hour of boredom and am pretty blown away. Keep up with the updates as im now locked in.
 
I HATE dirt bags like this. Without the blink of an eye I would toss in a few bucks to help with legal fees just to see justice served (understanding that you are not asking for that) Just know you have support!

A crappy story, about a month ago I found a supposed pristine lexus rx I planned to buy for the wife out of state. I also booked a ticket from Az to Cali and flew out to pick it up and drive home. The second I arrived - red flags went off, it was not even the car in the photos! Total mess, salt damage (claimed it had never been out of inland socal). He also claimed to have all dealer records and he had ZERO. Tires were miss-matched (AWD vehicle no no), tons of paint scratches and damage. The only thing that checked out was the car fax! However upon inspection the vehicle vin did not match the carfax vin he provided! And the cherry on top was the car was not even in his name!

After a near brawl with that SOB right there in the driveway (he ran to the back gate of the house... which NO ONE LIVED IN so it was not his home) I just decided to walk away. Grabbed my backpack and hiked it several miles to a gas station and called a cab who met me there and drove me to get a rental car. I cruised around socal and calmed down. Looked at a few other vehicles and decided the day was done - just drive home. Only bad experience I have ever had like that and boy it was one to remember.

That's really sucks brother. I had some bad experiences during used car purchases but this one...OMG. I am feeling sad by just thinking about it.

On one incident, I was looking for used accord for Dad. Its long story...In short he reminded me to bring 9K cash on all email conversations or calls. whenever I asked him about VIN he replied me with something else. Don't want to give me his address. Asked me to come somewhere near his home and told me I should call him for direction when reached mentioned place and only late evening times were available for transaction. On final movement...I came to my senses and I decided to call off meeting. I still don't know.. what was his plan.

To OP you are doing good but make sure you and your family life doesn't suffer... some time let it go is better for peace of mind. People like this seller can be millionaire but that money will never bring happiness. Best of Luck.
