Parking brake working by itself?

After I stopped the car and stepped on the parking brake then I realized that the pedal was depressed (or maybe half way depressed) already. Call me crazy but this has happened like 7 or 8 times. For the first 1 or 2 times I thought I forgot to release the parking brake when I started to drive. But that's definitely not the case here and I am sure I released the parking brake before drving and also the parking light wasn't on the whole time.

Anyone seen this too?

oh btw it's a 2004 4wd.

dont know how you would drive with it on when you hear if its on
