Did you admit to the officer that you were on the phone? If you said you weren't, What i "wouldn't" do is go plead not guilty and bring your wifes phone records with you showing that a call wasn't made or recieved at the time of the ticket.''
No matter what, plead not guilty, you could atleast try to get it reduced to a parking ticket.

This happened to me, however i WAS not talking on the phone and i even had more then phone record's for proof. I still ending up paying the $93 fine cause they found me guilty even with proof. I wish you luck.

Do the crime, pay the fine, my man. If you cannot afford the ticket, don't do the deed.
Anyway, I would plead not guilty and head to court. In my experiences even appearing at court looking anything but homeless has dropped my fines every time. A few times even the charges.

I remember a few years ago while in high school, came back from lunch and my friends just got our licenses : my friend got pulled over for having passengers in her Jetta. $250 per person x 4.. she wasn't too happy while we were in Chemistry that day...

I got one while sitting at a traffic light. I was out of town visiting my roommate trying to get directions to his house and the cop pulled me right over. I just paid the ticket because it would cost more to drive up to the court. The guy was nice, but I couldn't see why he just didn't give me a warning. Sucks, but I was on my phone.

In Ontario the recently new "distracted driving" law goes beyond just cell phones. "Handsfree" means you can't even have it in your hand, turned on or off.
Save whatever you get the fine reduced by to put against a Bluetooth device.
ps. No sympathy here. I have a personal dislike for drivers talking or especially texting since long before they passed the law. Worst was when I almost lost my truck to a young b!+@h who didn't even know she came right across out of her lane within inches of sideswiping me while texting. How do I know? I looked to the left as she kept drifting closer and saw her looking down with the thumbs working. Lots of other occasions. The law is there for a reason (to save lives; keep insurance rates down.) Sorry, end of rant.

what about paying a fine for something you haven't commit?
this state spends so much money on unnecessary programs and us people have to pay for their stupid mistakes.. fining people on for something he or she hasn't commit..
why not pass an law that cuts people off the system? how many billions of dollars goes to waste because of it..
how can you explain people that works that butt off for their family and barely making it through the week.. where as the people that doesn't work receives money from the government to spend on who knows what.. I seen people rolling up up benz and Bmw's with food stamps.. or in one case.. an $60K GL450 with food stamps? wtf?

Two wrongs don't make a right. Not disagreeing with some of the rest of your post (that doesn't appear to have anything to do with the law in question) but did you break the law or not? If not, then fight it. Not sure how your code is written and I'm not a lawyer. Best of luck getting it reduced.

KMVRETER- In California we have three laws that cover Cell phone usage
1. Distracted Driver-can also be used for loud radio, make-up or turning your head and talking to passengers etc.
2. Mandatory Use of a hands free device except in the case of emergency.
3. No text while driving- yes that means even reading a text you recieved.
One time my blue tooth died and I was pulled over to side of the road legally with vehicle in park and had a Cop pull up and still harass me, thankfully no ticket.
OP- It is very hard to fight Cell Phone and Seat belt tickets. 99% of the time the Courts will take the word of the officer over yours even if you bring in your phone records. All the officer needs to say is "Suspect appeared to be on the phone when I saw him." Notice the word appeared and not was same thing with seat belt. Appeared to not have it on. Sorry about your luck but I hope you can get it reduced at a minimum.

What's the point of having 3 laws to cover cell phone usage?
#2 & #3 appear to already fall under #1-Distracted Driver. They say "no texting" but I'm sure everything else like setting a GPS or even changing the radio stations can get you into trouble under the distracted driver law.

I used to drive like an idiot, so I had quite a few evenings spent in the court room. Typically they would cut the fine in half, depending on how much it was.
