Well... I got rear ended today, but....

Oh HELL NO get a lawyer !!!
I went through this same exact thing and my insurance company tried to screw me to the wall...I hired a lawyer got my truck (2011 Limited) replaced with a 2015 Limited with 10K left over, please don't let the insurance company try to settle it my insurance company started with low balling the trucks worth then came the sales tax I paid, lost work, doctors bills no rental, aggravation and so on without him I would of lost my mind

What happened in your accident? Were you at fault?

That's insane that you got a new 4runner AND 10k left over.
 
Well you do not find out they are crappy unless you want money back as long as you pay your bill no problem make a claim and the demons come out
and after I got what was owed to me I dropped that insurance company like a bad habit just like they would do to me ***BAM***

Who did you have before? Who do you have now?
 
As she is, no arguing facts.

Tell your PCP you’re concerned about your back pain and want to make sure everything is covered by a thorough exam. Being sent to PT w/o an MRI is foolish and could make things worse.

I will definitely be doing that when I make my visit. Anything else I should mention?

I just hope allstate is just as good.. How much at fault were you?

I wasn't at fault at all, the other driver pulled out directly in front of me and I had nowhere to go but into his beat up pickup truck.

No I was not at fault but felt like it !
I was rear ended on the highway by an F150, they tried to get me to settle for less than the truck was worth (they keep the difference), they wanted me to eat the 3,000 dollars in taxes I had rental on my policy and they would not honor it (fully) so I sued them all I wanted was what I lost...I also put 9K down on the truck and was told "I should never put that much money down" WTF ?

I'm a lawyer, although I don't do this kind of law, and if I were in your shoes I'd get a lawyer ASAP. Your own insurance company may be helpful in dealing with your car, but nothing else. They will not help you with your injury claim.

I'm a lawyer, although I don't do this kind of law, and if I were in your shoes I'd get a lawyer ASAP. Your own insurance company may be helpful in dealing with your car, but nothing else. They will not help you with your injury claim.

From consulting with many lawyers, it seems like they will only go further with my case only if my medical is greater than $10k, to make it worth both our time and money. So if it's worth less, I'll need to go through insurance...

Your insurance will not help with your injury claim at all unless you have medical coverage through your own insurance. Even then, the only help they'll give you is to pay your bills up to the policy limits.

If your medical bills are less than $10k, you'll probably have to handle the injury part of your claim for yourself. My friendly (not legal) advice, is to wait until you are completely sure you are completely done getting treatment before you agree to or sign anything regarding your injury claim. You can settle the damage to your truck separately and your insurance should help with that.

Once it's all said and settled, start a hot yoga practice and continue for the next few years.

Twice a month keeps me nimble and minimizes the after effects of broken neck and an acl surgery.
 
I have USAA. Someone else hit my 4runner while parking a while back, and they were nice enough to leave a note with their contact info and have their insurance (Geico or Progressive, I think) pay for the damage. USAA was fairly unhelpful about explaining the process of making a claim either with USAA or with the other party's insurance. I ended up settling with their insurance, and the amount they gave me for the damage was fair. I didn't even get it fixed since it is so small.

Everything I've heard about USAA is generally positive, but they are not perfect. To me it's worth using them even if I could probably pay a little less with another company.

It is frustrating that no one ever explains how to handle an accident, insurance claim, etc. You just have to figure it out as you go.

Oh yes I did...I did not want to do it but was forced to, because we actually pay for it in all reality but I was out a lot of cash and a two month old 4Runner I was bummed out about the truck being a total loss, the guy that hit me was texting and totaled both vehicles which was over 70K he was okay but he probably cannot get auto insurance now at least not affordable insurance

1. So regardless of the other parties medical coverage limit, as long as my medical coverage under my auto policy covers my bills, then I should be okay? IE: If I have a $5k limit, but the other drivers limit is $4k, and my med bills are $4.5k, am I SOL for the $500 that the other drivers coverage cannot cover?
-Dumb question; is medical coverage under my auto policy = bodily injury? Or is medical coverage something completely different?

2. So ideally, once my passenger and I recover, we then go to my insurance company and give them medical bills, to which they go after the other drivers insurance? Or do I go straight to the other companies insurance with paper work?
