Haaa, the BBB. They are scary. I am sure the dealership will be terrified of that. I find it hilarious that you are so smart now, but yet you somehow bought the car. Let me get this straight, you want us to believe that you asked about the smog check and took their word that it was good? C'mon man, you have to do better than that. Haven't you been watching the 'show me the carfax' commercials? You asked about something and they didn't show it to you? Having bought many cars I can tell you that you never take the word of anyone in sales.

The numbers were high, so what? It passed. That is all the dealer is obligated to do. Higher numbers mean nothing. It has 120K, and that wouldn't be shocking to see high numbers. They would only be on the hook if they sold you a vehicle that didn't pass.

As for the BAR, what can they do for you? As I understand they focus on auto repair, not auto sales. How can they assist you when nothing was repaired?

Look, I am sure you are embarrassed and angry. I would be also, but in your situation getting angry is not going to help you. The sooner you come to grips with reality and accept your mistake, the better you will be. Going into a dealer making unrealistic assumptions is clearly not the answer. It is time for you to put on your big boy pants and work through this like a reasonable adult. You signed a contract. That is where you should start your reading.
 
I agree with Sungod on the BBB. They are WORTHLESS. They have no authority what-so-ever.

True Story: Many years ago in upstate NY..there was a dealership that had a reputation for being one of the shoddiest and most deceptive dealer around. Yet if you ever did an inquiry to the BBB about them..they had ZERO complaints and always showed a clean record....Always getting a top rating. I personally knew at least 3 people who complained to the BBB about them. Then this article appears in the local newspaper about them. Turns out the president/owner of the dealership is also the president of the BBB. Need I say more.

This is getting fun now :bravo: Hows that window mounted antenna workin out for ya Sungod? Anyways, numbers from a smog are one of the best diagnostic tools to figure out efficiency of an engine. Low CO2 and high HC means a lot of unburnt fuel which indicates a cylinder or two arent combusting like they should. As for the dealership, they have no obligation to help me on this. As for their integrity, the general manager has agreed to partially compensate for what has happened, meaning we are splitting the cost of the quote from the original toyota dealer that diagnosed it. As an ex-service manager of a toyota dealer he agreed that their service center should have seen an issue with the engine. I guess you guys who are giving me a hard time for all this dont really understand the situation.

Glad you made some progress with the dealer, so are they going 50/50 on an engine swap? or are they only helping with a headgasket? If it's warped, can you even machine them? from what I've gathered just from reading other threads is if there is warping then you need a new motor, correct?
 
I wouldn't think it's warped since it's running mostly normal. I think if it was warped you'd see a lot more of the typical signs of a bad gasket.

I don't think anyone is giving you a hard time. You don't want to hear the truth and came here looking for sympathy for reasons you don't deserve. You have a bad combination of ignorance and arrogance. I could easily see why the sales manager tossed you out. How sad are you that you have to dig through my previous posts to attempt to call me out on something. It is even worse that even on the subject of diversity antennas, you know nothing, and I really see no need in discussing my hands on experience with you on the subject.

It seems to me that you blame people that shouldn't be blamed and now are finally assuming your responsibility. See how much easier things are when you act like you have some sense?

As I have said, I think you have every right to be embarrassed, but your anger at the dealer that sold you the car is totally unfounded. You should be angry at your mechanic who checked it out and the person that traded it in as well as yourself for not doing your proper due diligence. I personally wouldn't be thrilled at having to drop several thousand into a car I just bought, but their offer is purely out of their good will and there is absolutely nothing you could do to force them to help you. The dealer may have recourse against the person that traded it in because I know in MD you sign a statement regarding truth in mileage and hidden damage. That would then be on the dealer to pursue the person that traded it in, but for a few thousand dollars it wouldn't be worth their time and money along with the negative publicity.

Your assumption over the exhaust gases can be correlated with your HG issue, but there are a number of other reasons that could have caused those numbers, and not necessarily a direct diagnosis of a HG. It isn't uncommon to see higher numbers out of a higher mileage vehicle. I think what surprises me more than anything is that any new car dealer would sell a car with 120k. Around here those go straight to auction and you see them on the mom and pop buy-here pay-here lots just to avoid situations like yours.

Ok first off really? I didnt come one here for sympathy, i asked if it was a common issue and asked if anyone knew about the laws that were associated with it.

As far as this whole issue all together it was resolved and i am being refunded $1300 ordered by the general manager of the dealerships since they are sister stores. I am really happy with what i got out of it and I am also happy to say that you were wrong.

Also where did you ever read that i brought it to a mechanic before i bought it? I said i had him drive it. The car drove amazingly and as far as mechanically everything seemed sound. We both assumed something like a block leak test would have been done in the inspection when the dealer initially took it as a trade in.

HC levels arent the issue when it comes to the head gasket. Older vehicles will usually have high hc levels because they have less efficient catalytic converters. CO2 levels being low indicate several things as well, but everything they indicate is pretty bad.

Anyways, im not into talking to you and dont really know why you are telling my that i am embarrassed when im not. It would have been embarrassing if it was a different situation and the dealer didnt fix it. In this case both the gm and i realized it was an unfair deal and to maintain his integrity he had to do something about it. I even got an apology :) Especially after he heard what his sales manager said to me. All in all it got taken care of :)

Edit: OP, glad they refunded some money to have it fixed. Hopefully 300 miles and what appears to be a pretty minor case means it will be easy.

dont really know what he was talking about but i can vouch for the fact that cherokees are pretty damn good trucks. I just owned a 99 grand cherokee with the L6 motor and had 350k miles on the original engine and drive train. Those motors are bullet proof! The drive trains arent as good, this one had a little slop at the end, but i drove that thing for about 9 years and beat it up hard. Even lofted it off a few dunes in pismo. Sold it a 350k to a guy that is going to make it a full time crawler, which i am really happy to see that being the beginning of the end of its life.

All i can say is i hate people on these forums that go around with that kind of attitude. I do admit i went after Sungod a little bit, but that is because he chose to mess with me at a terrible time. You don't mess with a guy that is possibly going to have to drop 3k on a car he just bought. It's basically like disagreeing with your wife during that time of the month...

Anyways, as for an update on my situation. I talked to my father about the situation and he decided to take the matter in to his hand because he wasn't happy with me only getting $1300. After a brutal call to the general manager that i got to listen to, the gm was squirming and scared about getting taken to small claims. SO, now he agreed to have the repairs taken care of at the toyota dealership that originally diagnosed it, which was originally quoted a $3800 job. So anyways, not that i went to daddy for help, im an adult myself, but he helped a whole lot by knowing how to intimidate people. The gm basically knew he had a problem on his hands and in a court or law, small claims, it would have been in my favor. So good news is gettin better.

And for the record, i think this turned out to be a fair deal. I wasnt trying to get an upper hand or get 'hooked up' with them fixing it. I was just trying t make things fair. And it worked :)
