How is it a lawful order to tell a company to create a new product, one that does not presently exist and for which there will be no profit, just so the government can use said product to break the encryption of its citizens electronic devices?

I see a lot of arguing back and forth in this thread with no one able to answer, even at a middle school level, the basic legal question I posed above.

Any takers?


Here's a hint:

* The government CAN create rules that govern how a car must operate and the safety features it must have with each sale and to operate on the US government owned roads. If Congress passes applicable laws then the government CAN forbid sale or possession of vehicles that don't meet said standards.

* The government legally CANNOT force Toyota (or any other business) to make a special, "not for sale" car that is just for the US government, one that the government will then use as a special weapon to break into other American citizens cars so it can steal their private property from the trunk.

It's been several hours now. Still no explanation of how the government's position can even remotely be legal.

Does anyone here actually want the Executive Branch of the US government to be able to tell individual businesses what type of products they must create --- by order of the President?

I fail to see your point. Even if Apple wouldn't call it a product, that means they didn't have to spend R&D time developing the software, then testing it to be sure it performs correctly and without unwanted repercussions?

Tim Cook, CEO already DID call it a new product in his public statement.

Apples lawyers are already calling the demand a request for Apple to create a New Product in their legal filings.

that's the problem. just because YOU don't use your phone in that manner, you feel its ok to expose everyone else that might.

what you choose to do with your phone is your business, just like everyone else who may choose to put sensitive info on theirs, is their business.

neither you, or anyone else has the right to demand access to it.

I get it. There's no perfect solution and I respect your opinion......but crack the phone and protect the code or whatever you needed to do it like a deadly strain of Ebola.

Security trumps a phone everyday......and don't make it more than it is.
