My advice to you is to go for the police video/audio. It should not lie. I am not sure how the laws are in Cali, but you should be able to file a discovery and obtain the footage. I know the police in NJ have to keep it on file for 1 year. I am not sure how much you want to invest in this but it is a path you could take. Unfortunately it is not always perfect as I know by example:

One of my family members had an incident where a driver who had ties to the PD hit his car and it was a mess. I won't go into details, but let's just say we went as far as filing a discovery and obtaining police video because the accident report was inaccurate. Unfortunately, the audio on all of the police vehicles that responded were malfunctioning that day as well as one of the video cameras that had a perfect view of my family members car. We still can't obtain that footage because "it is lost."

My hunch is that this'll be the case here also. Has every time I've needed it anyway. That being said, several of my friends are LEO and most would give you the shirt from their back or stand with you at the gates of hell if necessary. In defense of these guys, there are d-bag doctors, grocery store clerks, and roofers as examples as well.

I agree with you, there are bad apples in every profession. I have many friends who are officers and they are very nice. I feel that certain professions should have more checks and balances thought. The only thing that cannot lie in certain situations is a microphone and dash cam. For that reason, it should be protected and accessible to all necessary parties.

I got a ticket for going 5 mph over on 17 N . in Va. the trooper told me " HERE IN VA. WE TAKE SPEEDING SERIOUSLY , AND 1 MPH OVER IS SPEEDING AND YOU'LL GET A TICKET EVERY TIME." . now my 4runner barely goes 65 mph, so i'd be happy to get a speeding ticket on the hwy

I am quite familiar with US 17 North (drive it regularly with work) and I know there are certain parts of it that are known to be "speed traps" by motorists far and wide.

It seems odd that you were ticketed for 5 mph over, as most people do that as a matter of routine. Were you in a school or construction zone? Was it really a state trooper or was it a county deputy? Were you caught on radar or did he pace you from behind? Did you have out-of-state license plates? That can sometimes make a difference.

Some of the bad parts of US 17 include Fauquier County and part of Stafford County - where the limit goes from 55 to 45 mph for little apparent reason. There is a part north of I-66 (Delaplane area) and south of US 50 where a whole lot of rich, uppity folks live and HATE big trucks on "their" road and encourage the sheriff's office to nail out-of-towners & big truucks as much as they can. They recently put a "No Thru Tractor-Trailers" restriction on that stretch of road, but box trucks, straight trucks and dump trucks still use it as a short cut. To say they are overzealous up there is an understatement!

Essex County, near Tappahannock - also along part of US 17 - is another hotbed of ticket writing. Little tolerance is shown in that area and they don't give much leeway. Don't know about 5 mph over, but I would not do much more than that!

P.S. Most officers/deputies I know will usually allow 10 to 12 mph over if the limit is posted at 45 mph or higher. Some even will give you 15 because so many roads are posted far too low anyway.

yah I think it was near TRAPPAHANOCK , north of Newport News and I think Portsmouth , yes I did also have out of state tags too. Luckily for me I don't have to go down that way any more seein that my brother got restationed elsewhere.
