S1422-2013 - NY Senate Open Legislation - Increases the penalty for the possession, use, or sale of certain firearms and ammunition and redefines "assault weapon"; repealer - New York State Senate

RIP to our 2nd amendment in NY.

Pretty absurd, IMO.

One part (S 265.02 p. 5 i) says that if you own 3 or more firearms, you are in criminal possession.

Opinions?

I guess I would know a LOT of criminals if an article like that became an Executive Order or federal law.

JUSTIFICATION:
On Monday December 24, 2012, William Spengler, Jr., reported a fire to
the local fire department in Webster, NY. Then he waited with three
guns, one of which was an assault rifle,
for the firefighters to arrive. He killed two and seriously wounded
two others. Mr. Spengler was a convicted felon, and as such, was
prohibited by law from owning firearms. Somehow, he
managed to obtain them anyway. This horrendous incident, the massacre
at Sandy Hook
Elementary School in Newtown, Connecticut ten days earlier, in which
20 six and seven year-olds and 6 faculty and staff were murdered
execution-style, and other mass shootings that have occurred -
Columbine High School, where 12 students and one teacher were killed
and 21 injured, the Clackamas Town Center Mall in Oregon, where 2
people were killed and 1 wounded, the Sikh Temple in Oak Creek,
Wisconsin where 6 people were killed and 4 wounded, the Century Movie
Theater in Aurora, Colorado, where 12 people were killed and 58
wounded, and in broad daylight, Tucson. Arizona where six people were
killed and 11 wounded, including Congresswoman Gabrielle Giffords,
who was severely wounded - clearly point to the need to ban
assault-style weapons, for stricter gun control laws and increased
criminal sanctions.

This is actually in the code.

Spengler was provided firearms illegaly from a lawful owner.
Sandy Hook is still being sorted out and those firearms were obtained illegally from a lawful owner.
Columbine happened during the last firearm ban.

I could go on but this thread is likely already doomed... sorry New Yorkers. The only good news about them being first is that it may prove, in time, that criminals don't give a rats ass about new laws, before it goes federal.
 
I read most of it and it doesn't really seem 'absurd' to me.. Don't know why a normal person, even one that likes to hunt or shoot needs guns with drums or belts or huge clips..

And as far as the second amendment goes, it was written in a time where they were firing muskets.. Like pour powder down, place ball, pack powder, put firing cap on, then shoot from close distance.. I don't think they intended every citizen (including the mentally handicapped and insane) to be able to wield assault rifles with 40 round mags.. I'm all for the right to bear arms but their needs to be stricter legislation on the sale of guns.. As of now you can walk into a gun shop/show, buy 30 guns "for your personal use" then decide you don't want them and sell them out of your trunk to anyone.. That shouldn't be legal.. Just my $.02

No seriously... inform yourself. It's not legal to sell them to just anyone. It's the enforcement of existing laws that is flawed. Its the lack of security in places that currently disallow licensed citizens to protect themselves that is flawed. It's the logic that new laws will deter criminals and the insane that is flawed.

Every shooting tragedy to date already broke multiple state and federal laws. Do you think more laws will stop this?

In NYC, this isnt legal. I agree about more control in some ways. And I agree with what you say above. But just trying to get a shotgun here for hunting is almost impossible. Over a year wait, and maybe you get it. Handgun? Forget it! You have to personally go to 1 Police Plaza to get an application after you show I.D. Unless you handle large cash amounts, a normal citizen will be denied a new permit for a handgun.
 
Ah well that's not how it is in AL. They sell every kind of gun at Walmart, academy, gun shows and pawn shops. And I'm not saying to take guns away.. I'm saying there's no reason to need a gun THAT day when you go buy one..

For instance, a wife tries to leave her abusive husband but is afraid he will hurt her, so she gets multiple friends over to help her move out while he's at work, they take all his guns out of fear because he is unstable, but that didnt stop him from acquiring all these weapons. So he comes home, gets in a rage but since she has male friends with her, and they took his guns he can't do anything.. Problem over, right?

Not quite.. So he gets back in his car, and leaves and 15 MINUTES later he gets back with a shotgun he was able to buy at a pawn shop... Now obviously there's no reason you would need a gun on such short notice for anything legal, but the law allows it. So now he shoots at them, she runs, he chases her into the neighbors yard and pumps her full of lead in the back.. Kills her. Now I'm not telling y'all this to say ban guns or w.e, but this happened in my neighborhood, and I think with slightly more regulation on gun trade that kind of disaster could be avoided. Just don't think it can't happen to someone you know.

I'm very "informed" and understand my rights, I own many firearms. But that being said there's no reason for something like I just said to occur.. If a law had been in place that required you to wait a day, or even a few hours to pick up your weapon, those kids might have a mom. So I'm not arguing with anyone, but I don't think you'll be able to give me any reason that man, or anyone for that matter should be able to legally acquire a weapon in that amount of time.. I know most everyone here are responsible people that would never do such a thing, but there aren't 350 million good people in America, so I would condone a stricter buying process on firearms.

You can't be serious... the guns the Sandy Hook shooter used were owned for YEARS by his mother prior to the event. The planning in the Aurora Theater shooting took months to prepare. I'm fine with a wait time, although it doesn't apply to me now because of the CWP, but it would not change a thing in these events. I'd be interested to see if these cooling off periods have had any effect of violent crime. In fact, name one mass tragedy where the firearm used was purchased the same day.

Saying that stores sell guns is not an argument. Of course stores will sell guns if they are willing and there's a demand... and they all follow state and federal restrictions, especially the retailers you named.

Oh, and btw, Alabama prohibits the private sale of a firearm to what it deems a prohibited person.

You may very well be the least informed fellow gun owner I've ever encountered. :eek:

Prohibited person? I doubt the kind of people that do what I was just talking about care if its a "prohibited person". But if ur cool with people buyin arsenals of weapons to sell on the streets that's cool with me, just hope it stays in your hometown haha. Think I've said all I want tho. Stay safe!

Right... so there are already laws that prohibit it... and you think more laws will stop it? :crazy:
 
What's the point in replying if you don't read? It's LEGAL to buy Twenty semi auto rifles with 30 round mags for "personal use".. That is what I was saying shouldn't be legal. But your right, later.

according to your thinking the first amendment is also obsolete since it doesn't take into account twitter facebook and these forums that were invented since the signing of the constitution and the fore fathers had no idea how far freedom of speech would reach. Times change and so does technology. If you believe their view of what firearms should be you should stop using public forums to broadcast your views and enact your freedom of speech. Goes both ways now huh? :wow2:

So I guess you shouldn't use this technological forum to express your First Amendment right to free speech since it wasn't invented at the time the First Amendment was written...

Anyone who sees the 2nd amendment as being written in for hunting is a fool. It's to prevent a government from oppressing and enslaving it's people. Which is exactly what's happening bit by bit. Yeah, it was written when we were using muskets. So was the army. I'm 100% certain that it's well known fact the US military and other government agencies have upgraded past muskets. So should the American people.

You people in this thread saying "lol, sucks to be u new york, alabama is set" are part of the problem. If it can happen in one state then it can happen in more.
