odometer fraud!

either the dealer changed the mileage or someone at or with the auction did it.

Is the dealer inventory on 3/27 & 4/5 the same dealer you bought it from? If not, was purchased at auction on 5/20 by shady dealer, taken back to their shop and "clocked" sold to you on 6/3 with low miles but EXEMPT on the Odometer Disclosure.
Unfortunately, if you bought it EXEMPT, you really don't have a case. I'd love to see you nail these guys but that EXEMPT mileage is exactly that, they weren't selling or disclosing to you that it had 98,XXX on it. If investigated, they'll claim it had a bad/damaged cluster when they bought it and that's why it's lower now.

it looks that way. the guy i bought it from told me that he/they(dealer) bought it at auction as a one owner truck with low miles of 97k. why then if they know it is low miles, make the title EXEMPT?
 
I was shopping for a 4runner in Orlando a few weeks back. found the 4r on craigslist. it was at a small dealership. Took it for a ride, did a vin check and bamm found out it had been rolled back about 130,000 miles. When I told the owner about odometer fraud he took the keys and walked away. He never did take down the add either. Hope all works out for you.

the guy sells cars out of his house for the dealer man. that sounds straight up shady. i should have seen that. he sells cars in orlando for the dealer in ocala then has to drive to ocala to complete and submit paperwork for the sale and title? shysters all the way!

kinda related question... how can you "roll back" a digital odometer? or do they just replace the console...?

and sorry for your troubles man... i stick to my original saying "if it seams too good to be true, probably is" .... sucks, i'd still through that ****er to the wolves though, call the sheriff for fraud, talk to the DA, maybe sue if all that fails.... and tell everyone what the douches name / dealer is so they don't get hosed too!

I don't know the FL. laws but in every other state I lived in they committed fraud.

So what is the remedy that you seek?

same odometer fraud, title fraud. from what i read on the florida statutes, the person/dealer faces 3-4 other counts added at at least 5k fine each count and up to 5 years in prison. and they have to pay back the purchase price of the vehicle.

Hold on. You said they signed it mileage exempt. Now you're saying they didn't and you found out after running a CarFax. Which one is it?

Everyone in this thread has been trying to offer advice & support. But that's hard to do if we're not getting the full/accurate story.
 
I'm not sure if it's all states but here in Mississippi its back A$$wards.

When I bought my year old Tundra a few years back I got a mileage exempt title. I bought it certified through a Toyota dealer.

Anyhow every vehicle that I've purchased and sold through Ms has been mileage exempt. I put the mileage down when I sold that truck to a buddy and it still was mileage exempt.

Hopefully something good comes out of your findings

when the bill of sale was written up, he wrote EXEMPT for mileage. the only thing in my mind is that it is an old truck so mileage isn't recorded nor important.
but when i get the carfax and see that the mileage is 206k+ before i bought it, and it is listed as having 97k, then hey, there's a problem.

I'm not picking on you, just trying to fully understand what happened. I asked you what they disclosed, you said "exempt." Then someone else asked and you said they didn't disclose anything and you didn't find out until you got a CarFax.

Your statement above you say mileage isn't important but then go on to say it's a problem. Mileage is obviously important otherwise this thread probably wouldn't exist.

I do agree with you that it's a problem but since you took it exempt I don't see why/how you're going back after them for a mileage discrepancy. Each state is different so I am curious to see how this all plays out for you in the end. But I would highly recommend that in the future you look the title over carefully and run the CarFax prior to your purchase. You may very well have a solid truck even with the 200K on it, but had you been armed with the knowledge of the odometer issue, you most likely would've gotten it for a lot less or walked away from it.
