Rear Ended yesterday

Well it finally happened to me.I was taking the wife to see her surgeon for her post op visit. Sitting in traffic at the bottom of a bridge waiting for the car in front of me when..wait for it ....I looked up in the rear view and I see a scrap heap of a chevy pickup just fill up my rear view mirror and slam into us at speed. I would guess dude was preoccupied with his phone. My trailer hitch shoved his license plate and his bumper in about a foot and a half. So the truck took it tuff but my rear tailgate and bumper are both shot muffler rattles and the steel brackets fopr the bumper are toast. ouch my back hurts

One of the first things a officer ask for is your #, they run a check to see if texting, ect. Been there before.

Looks fine to me. I once had my car rear ended to the point where the bumper was turned into a "V", including the trunk. I got out of the car to see a horrified teenage driver expecting me to freak out. I looked at the bumper and said, "That's not so bad." I got back in my car and drove off looking at the speechless kid in the rear view mirror. It was my good deed of the month.

where do you see fine there is $4000 worth of damage:lookout:Buddy hit me at 40 mph. the receiver took most of the impact. flipping whiplash still hurts and i have had a headache since last Thursday I would like to get my truck fixed but his insurance agent from all state will not call me back i have called her six times and left messages no luck . That's why I got one of these for my truck. The one I have fits into my receiver. Had a smaller on one on there from Pep Boys and after a car backed into that one (no damage to truck) I said I need something bigger. I dare somebody to hit me now!!!!

Distracted driving is a dangerous annoyance, but at least in Texas no matter what the cause, the guy who hits someone from behind is always at fault.

Correct, same here. At an accident scene they ask for your #. They check to see if you where distracted by a call or TEXTING.

I'm a truck driver, was T boned by a car that was texting. Witnesses stated I possably ran a red light. Was put in the clear 6 months later, not running a light and her texting, her at fault due to that.

Cops can ask all day long (just like asking you to take a breathalizer), but you can decline and tell them to kiss your whole butthole. Which socialist states do you guys live in that require you to give up your 4th Amendment rights?

Edit: Wait.. I see at least one of you lives in Commiefornia. Makes total sense now as to why you'd give up your rights. =P

You know, when you get at my age, you tend to figure out when it is wise to give up certain info as to put yourself in the clear from major incidences.

And with me having a class A license, I'm more scrutinize in ANY state I drive in.

Stop calling the allstate agent and get a lawyer. No unecessary stress is needed especially with your wife's recovery and damaged T4R.

Telling a cop to eff off? Yeah, good luck with that. Show respect to the police officers who are trying to solve what happened.

I think its universal that whoever strikes the car in front of him is at fault.

I think you're giving law enforcement way too much credit here. They are not there so 'solve' anything. They are there to record the incident and move on. As they saying goes 'when seconds count, help is only minutes away'.

If you want to sacrifice your right to privacy under the misguided idea that you won't get sued, then by all means do so as one thing has absolutely nothing to do with the other. Being 'sued' is a civil affair, not a criminal one, and giving up your cell number won't prevent that.

Sorry buddy, hopefully you will get better soon and the truck will be fixed.

I was just rear ended last month on the HWY and the guy clipped my left rear bumper, punctured my new tire and damaged my wheel. No biggie, since it wasn't my fault. I called the guys insurance company Liberty Mutual to file a claim the next day. Liberty Mutual took 4 days to call me back WTH! After their investigation, they said I was 10% at fault because the other guy said I was moving and I said I was stopped when I was hit. The HWY Patrol said the other guy was 100% at fault for speeding but Liberty Mutual still insists that I'm 10% at fault. Total repair cost is just over $3200.00 using after market parts and a recondition wheel.

OP, call a lawyer right away and don't talk to their insurance company without consulting with your lawyer.

Photos of the damage to my truck with the 13 year old spare tire and it still had 30psi.

Why did you call his insurance company instead of yours? Never ever ever try to handle a claim against some other guy's insurance company by yourself. Let your insurance company go after his policy so you don't have to.

A lawyer should only be involved if there's a criminal complaint or you feel the need to sue for medical bills that both yours and the other guy's policy won't cover.

OP, hope you're back gets to feeling better, as well as your Runner.

As an aside, it may be worth contacting your insurance, as typically they will pay your claim less your deductible, then pursue the at fault insurance for damages and refund you the deductible once they have settled with the at fault provider. They are bound to refund the deductible to you as soon as they receive funds. You shouldn't need to lawyer up, typically that costs more than it's worth in a situation such as this one.

Also, I have to question why people wouldn't cooperate with the police investigating your accident scene. Do you feel that not providing them information is in some way helpful to you? Especially if something as simple as providing your phone number could get you out of a ticket?
