Terrible experience with Orange Boxx Fabrication PSD rack

IIRC it was thrown out and Baja was allowed to keep manufacturing.

Well I went through the hassle of creating an account on rpxcorp.com. It definitely says that they negotiated a settlement and entered it into the case in December 2016 and the court closed the case due to settlement of all issues on 01/09/17. Good, think I'll get a Baja rack as my next purchase.

Gobi issues aside, hope Bajarack fixed all their mount issues from the roofs they damaged :(
 
They sued smaller businesses on some patent nonsense. unlike orange though gobi seems to put out a good product so it balances more so than crappy product and crappy servixe
They were protecting a valid patent and people got upset about it because they never took the time to look at the patent themselves, the people they sued copied their design and were violating their patent and because this is the internet morons got mad about it even though they don't know the first thing about how patents work

Don't get me wrong i just bought a gobi last week, i just don't want to be flamed for siding with gobi. If it upheld in court there was a reason, also GB are always going to be a problem for businesses when custom ordered rack orders come in by the hundreds all at once. Orange though again bro you should have just let anna handle HR.

Right. The reality is they went after a small guy because they claimed they patented any rack that attaches to the roof of the vehicle. They just had more money for a lawyer. It's for that exact reason they lost to Bajarack. Gobi is just a patent troll and focuses too much on competitors instead of focusing on making their product better.

But they gave a timeframe for a group buy and the last 2 and they never even meet them. Even people who weren't in the group buy were lied on numerous occasions and their racks were delayed beyond the promise date with no explanation.
No worries on getting a Gobi I just think this thread is ironic and people claiming the company has horrible customer service when Gobi was flamed on this forum for similar things. Lawsuit aside their handling of orders and deliveries and misleading the client on a consistent basis is just poor customer service.

Already read the patent and so did several others in the legal field. As you will find out patents are worded as vaguely as possible to insure they cover everything. Might want to do a little research yourself. Fake facts...im not familiar with these please elaborate ?

As stated patent aside Gobi has been well documented on this site for poor service.

Go to the thread and see where I posted it and you will see several sections pulled from the actual patent to show how they claimed they patented a rack system that attaches to the stock vehicle mounting points, and somehow claimed Every other company is infringing on them. Also pull up the other dozen plus patents they own and the multiple lawsuits they are in with other companies. From roof racks to cell phone cases. Yeah man they are quality.

it's an ornamental design patent, ornamental design just means that you are patenting the look of something. no where do they attempt to patent any rack that attaches to a roof as you claimed (you would not be able to patent this because there is obviously plenty of prior art showing racks attaching to roofs)

Oh you mean like you just did. You completely ignored the topic and the fact that Gobi didn't submit for a court date like they said but a cease and desist. They created fake accounts for damage control on the forum. Their patent as discussed is vague(as the patent system shows this is better in the long term). The design from an engineering standpoint were completely different.
So again pick and choose what you want to Google and post. But the reality and proof is in the thread and the events that followed. Patent system is shit. And Gobi instead of taking competition decided to oppress a better product.

As for the Baja rack update:
But so far here is a quick summary of some of what i found most amusing:

1. Baja called out gobi on all of their BS allegations. Gobi claimed hat BAJA was aware of the patents since 2012. When they were only actually filed in 2013 and it would have been impossible to be aware of them since 2012. that was for the jeep roof rack patent. Gobi made the same mistakes with the FJ ladder claiming 2006 when it didn't exist until 2007. Unfortunately the suit wasn't thrown out but gobi was allowed to amend their suit with the correct dates.

2. Baja has filed a counter suit which it is looking for the the design patents that gobi has to be thrown out, since they are so vague and aren't for anything specific. And that Gobi also pays relief to them. basically covers their lawyer fees, costs, damages and such.

3. Baja then goes on to say that the "patented and patent pending designs" that gobi lists on their website is a whole bunch of B.S. because of the list of 50+ Intellectual property at the bottom of the page includes expired patents, patent application serial numbers and patent application publications that confer no enforceable right. foreign patents not enforceable in the US and other patents wholly unrelated to roof racks and ladders.

4. (this is one of the good parts) Baja also uses the "unclean hands affirmative defense" what that means is that they are accusing Gobi of acting unethically and in bad faith and thus they are not entitled to obtain any remedy. AKA calling Gobi a patent troll!!!

5. More info added to their countersuit claimig that gobi is intentionally marking their racks and ladders with expired patents, patents it doesn't own and patents with no enforcable claims in an effort to limit competition from other companies.

6.(this is my favorite part so far) Baja uses Gobi's suit with WMW as an example of them "patent trolling" to limit and force their competition out of business. Sadly, since WMW doesn't make the roof racks anymore... It is a very good argument.


Now onto the differences between the Gobi and Baja items:

The roof rack for the Jeep, has tons of differences between how it mounts to the body, and support points. the only thing they share in common is that they both take advantage of Jeeps shitty production quality with huge body gaps.

The FJ Ladders has grossly different means of attaching to the back door, And Baja's looks to be superior. The only shared features appears to be horizontal rungs. and Gobi sure as hell doesn't own the patent for those, since according to wikipedia ladders were depicted in mesolithic rock paintings that are over 10,000 years old.

So again with the circular rant. A little more research may be needed on your end. Maybe not, but at least don't be biased to one side.

i don't know the first thing about their customer service, they sound shitty, i don't have a gobi rack, but they have a design patent for racks that look like theirs. you can see their design in their patent, if you make a rack that looks like that it is infringing on their patent. if you think their design is not original then show the prior art, that would invalidate the patent. stop being an internet moron.
