Back in 2005, My coworker had an 2004 4Runner and was t-boned by a 45-50 mph, red light running Sequoia. Although it was her fault his insurance company said they would fix it at their shop. Weird, right. They stated the damage was not bad but kept delaying the delivery date. He gets his 4Runner back but knew something was not right. It drove funny and the driver seat was touching the center console and he was having a tough time putting on his seatbelt. He took it back a couple of times but they kept saying it was fine. He finally hired an attorney and they had an independent expert take a look and the vehicle should have been totaled. He settled out of the court for a non disclosed huge chunk of cash. He bought a new 4Runner and left his job and became a part time consultant.

My name comes from my first car, Subaru Outback. When I was younger, I wanted an outback, so I looked around on forums, and since it was my dream car to own at the time, the name just came together... hahaha

Now, the one thing I will tell you, is to DO NOT skip out on any medical. All of your bills will be covered in the end by the other person's insurance. So get any and all medical examinations you may need including CAT scans and MRIs Etc.

A big payout now sounds good, but it won't pay you for your medical bills 20 or 30 years down the road, when the problems start to show up again. So make sure you get yourself checked out really, really well.

I will not skip out on any medical. But my question is, how often should I get any medical examinations? And where should I begin? I've never had any accident this severe, so I don't know where I should start looking..

I definitely do want to get checked out soon.

The doc said that he's surprised I didn't knock out, because of the fact that I was launched forward, and up out of my seat since she went under my car.

My spine is messed up and out of line from the xrays they took. He just told me to take it easy for a week, and then go try physical therapy, as well as go to my primary care provider.

Was the rear end tube something that could fix the frames alignment? Or is the frame forever effed up?

And is the rear tube welded or bolted on?

Not sure about Celino and Barnes. I'm in AZ and not sure about Cali attorneys. I would ask family, friends, coworkers, etc. If they don't know of a good one then check the internet.

A good attorney will give you advice on medical exams and will handle and the insurance companies.

Darn.. The only issue is I've tried asking family/friends/coworkers, but they all do not know a good personal injury attorney.

Thanks. It was SERIOUSLY scary.. Just a normal, nice day, and then BAM. Everything gets shaken. At a blink of an eye, i'm flying out of my seat with the seat belt restraining me. Next thing I know, I have a neck collar and laying on the bed, and put into the ambulance. Such a terrifying experience.

Insurance will give you book value. With standard equipment and in excellent condition, KBB shows about $13,300 for retail sale price and trade in range of $11-13k. If market value differs from book value significantly, you can make a case for it and get more.

Since you just bought it, you can try to use the price you paid as evidence of the value if they offer you less. You could also consider working with your insurance company and having them fight on your behalf if the other insurance company isn't helpful. It could be worth at least calling yours to ask how to handle everything, if you haven't yet.

If you can get a fair price for it, it's probably better to have it totaled than for it to spend weeks/months in the shop and not be 100% sure that everything is fixed correctly in the end.

This is more important than the truck. The other driver was at fault so they have to pick up all the expenses you incur. Get checked out now, don’t wait.

X-rays are good for spine problems but an MRI might show something that’s not visible on the x-rays. One w/o the other is bad news, tell you PCP you want both. The other insurance co. has to cover all your medical costs even if nothing turns up.

Definitely totaled - I'd not accept the settlement check upon first offer - take few weeks and haggle for a better buyout price in the meantime. insurance hates dealing with cases that includes a totaled vehicle, they prefer to offer and close quickly to avoid time and effort being wasted

I'll go ahead and do that! Just hope that I do get a fair price, especially since I just did get it not only a few months back... Seems ridiculous that I have to loose nearly $3~4k (if they only give resale value), for someones negligence.

Yea, honestly, I don't think I could deal with A) owning a salvaged car B) wait for a long time to get my car back C) Nothing will ever be the same as it was before.
