Bushmaster Lawsuit

What are your thoughts?

Seems utterly senseless to me. Like suing Hummer because some drunk driving one killed a family member.

Sadly Bushmaster has faced similar suits including paying damages on at least one.

Going after a specific manufacturer of a long gun made by many that is only responsible for a fraction of a fraction of gun deaths. No sense.

I don't believe it's been established that it was a Bushmaster in the trunk of that car anyway?

Utterly ridiculous lawsuit either way, like suing Corningware for making me fat.

I'd be interested to learn what precedent was established that people are able to successfully sue someone or some company instead of being accountable for their own actions or circumstances.

I think it started with the a55hole that sued McDonald's for getting burned by hot coffee.

a quote

"Bill Sherlach, whose wife Mary, a 56-year-old school psychologist, died in the attack, said the suit seeks to hold the company accountable for its weapons sales.

“For far too long, the gun industry has been given legislative safe harbor” for selling weapons to untrained users, he said in the statement."

Sandy Hook Victims' Families Blame Bushmaster in Lawsuit for Shooting

and a mother of a victim stated that bushmaster: "should’ve known it (AR-15) would’ve been used in a mass shooting to inflict maximum casualties."

Sandy Hook Parents Sue Bushmaster: You Sold ?Weapon of Choice? for Mass Murderers - The Daily Beast

this whole thing seems a little money grubbing....

So why aren't these completely logical people suing Honda? After the punk stole his Mother's gun, and murdered her with it, he stole her Honda and drove to the school.

If Honda hadn't made that car, he wouldn't have been able to drive to the school. Honda certainly should have known their car could be used to help commit mass murder..

They're a big evil company worth trillions. They should be held accountable for making this heinous act possible..

They are too busy getting money from Toyota as well as "wonderful" (absolutely sarcastic there if you haven't caught that yet) recalls like the craptastic 90L Pedal Butchering Job & the BST Software that neuters your ability to brake stand in a Toyota (I'm genuinely surprised it doesn't cause accidents with how it works.) You know... because the large majority of twats can't (a.) Drive/Operate a vehicle (b.) Drive/Operate a vehicle in an emergency situation (c.) Know what "NEUTRAL" means (d.) use their brains for anything other than being idiots.

I know I'll probably get some flak for saying this, but really any of the parents/family trying to milk money and publicity out of these tragedies from companies like Bushmaster for this idiotic drivel is better off with their kid/family member dead because at least that child/family member won't suffer a shallow, idiotic, and uncaring family that wants to make a quick buck on their barely cooled corpse!

I understand that comes across as very callous and heartless; but I can't believe these people would reduce the value of what they have lost to simple cash and political agendas. I can sympathize that you want to at least do something with the pain and anger, but this just dishonors the dead and the reality of situation, its the same slime that the Liberals push with their anti-gun propaganda train that they hitch to what ever fresh mass grave they find; to the Conservatives manipulating data to make their loony toons BS sound barely borderline batshit crazy instead of ridiculously asinine all on the tragedies of others.

This type of crap is what is wrong with the world... instead of honoring the dead and trying to solve the underlying issue, [we] (general lumping of all humanity here) would rather use their corpses like some sick ventriloquist act for our greed and egos. This is the kind of crap that supports my lack of faith in humanity.

I'm guessing the lawyers, anti-gun politicians, and opportunistic families got together and realized that if they can get a multi-billion dollar payout like the case with the tobacco companies the gun sellers will all suddenly become scared to sell to law-abiding civilians and this will essentially act like a back door gun ban...

Since many firearms and accessories are manufactured by smaller companies, this would essentially wipe the market clean of any companies except those who derive a big deal of their finances from .gov and .mil contracts.

Gun control is death by a 1000 cuts. Obama and his buddies got their asses handed to them the last time they did "common sense" gun legislation, so instead have relied on scumbag backdoor schemes like the SAFE act, Hickenloopers mag ban, California's asinine microstamping to do the work for them.

If this law suit succeeds I guarantee you many gunmakers will be too scared to sell to civilians.

Flak for saying those children are better off dead because of the parents they didn't choose are misguided in their pursuit of justice?

Yeah, F you buddy.

I agree. Here is the problem and I think this is what BlackWorksInc alluded to:

Guns=politics and that's the big problem with this case. You have the victim's families sure but the guys behind them urging the lawsuit on have agendas that have nothing to do with that incident. Then you have guys behind the guys with a different agenda.

I read recently that the compounding drug company that killed several people a few years ago (contaminated medicine) just had 12 people finally arrested. This was a little mom and pop compounding pharmacy not Bayer or Pfizer. They pharmacy of course was sued and went bankrupt and the people responsible for the deaths are going to jail. Here's the catch: The big drug manufacturers that provided the little pharmacy with the initial drug stock did not get sued. Why? Because everyone rightly concluded that the little pharmacy screwed up, not the drug companies.

How does this apply to the Bushmaster case? Simply the politics of it all. Very few people don't like prescription drugs and think they are evil. Lots of people think guns are evil and want to punish the manufacturers. The other difference is accountability. In the tainted drug case having the people responsible go to jail is closure. Justice was served.

In the Sandy Hook shooting the guy responsible is dead. That's not good because there is no way to punish him in their eyes so a scapegoat is needed. Enter Bushmaster.

Everyone knows that Bushmaster had nothing to do with the shooting of the gun. The stupid guy did that. So what. Politics is the driver here unfortunately and people are trying to further their agenda on the tragedy of Sandy Hook. The suing parents unfortunately are nothing more than pawns in this case as the people with agendas are the true driving force.

Actually that #@@@@@@ as you say was a older woman who got burns down her body because the local MD's has set the coffee machine temp way way to high to serve and when she stopped to add creme and sugar the lid spilled.

Everyone always points to that case but it didn't happen the way it was portrayed in the media.

Liebeck, 79 at the time, ordered coffee that was served in a styrofoam cup at the drivethrough window of a local McDonalds.

After receiving the order, the grandson pulled his car forward and stopped momentarily so that Liebeck could add cream and sugar to her coffee. (Critics of civil justice, who have pounced on this case, often charge that Liebeck was driving the car or that the vehicle was in motion when she spilled the coffee; neither is true.) Liebeck placed the cup between her knees and attempted to remove the plastic lid from the cup. As she removed the lid, the entire contents of the cup spilled into her lap.

The sweatpants Liebeck was wearing absorbed the coffee and held it next to her skin. A vascular surgeon determined that Liebeck suffered full thickness burns (or third-degree burns) over 6 percent of her body, including her inner thighs, perineum, buttocks, and genital and groin areas. She was hospitalized for eight days, during which time she underwent skin grafting. Liebeck, who also underwent debridement treatments, sought to settle her claim for $20,000, but McDonalds refused.

During discovery, McDonalds produced documents showing more than 700 claims by people burned by its coffee between 1982 and 1992. Some claims involved third-degree burns substantially similar to Liebecks. This history documented McDonalds' knowledge about the extent and nature of this hazard.

Yeah cause I was like four when that happened so my memory of it isn't as clear as someone that was older at the time. I will search for the details now. Regardless, it was one of the more memorable frivolous sounding lawsuits.

Edited, I googled the case and what you reported isn't accurate. The lady's lawyer argued it was served too hot, it wasn't a mistake, it was how McDonald's served it at the time. Also, the lady's car didn't have cup holders, why not sue the car maker too. It didn't burn through the cup, she spilled it trying to add cream and sugar.

Was the AR-15 modified? I don't think so. They can't even argue that the company was negligent BG making it easily convertible to full auto . it was just a standard semi auto gun, no surprise. The lawsuit won't go anywhere.

My memory wasn't clear either, so I edited my post. My point was just that the media and Jay Leno seized on the story and twisted it to make sound super frivolous.

I think it could have been alluded to without suggesting those innocent children are better off murdered.

Were these parents "greedy and opportunistic" before their child was murdered or stricken with grief and confusion about how to cope with the senseless loss of of their child and only after the fact have they been as you admit coerced into a frivolous lawsuit.

I'm pretty sure they were (are) good normal parents that are in a terrible situation. I for sure would not want to be them as I know every single group that wants to get rid of guns has been hounding them since day one. Add to that the lawyers with $$$ signs and politicians with their own agendas it would be a nightmare and very few would have the intestinal fortitude to stand up to all of the opportunistic leeches. I'm surprised it has taken this long. Sometimes it's better to capitulate and move on and I think (I don't know) that is what the 10 who are suing have done. The rest are either still fighting the sharks or have a different plan.

Like I said, I'll get flak for it and I get that; I can be very blunt. But people's true character tends to show in situations like this. Which tells me these people should never have brought innocent life into this world if they couldn't bother to love and honor it. The child didn't choose to be born to irresponsible and uncaring people, but the idiots who made them should have known better.

Like I said it is a harsh thing to say, but it truly disgusts me how these people dishonor and mistreat the memories of loved ones. To me that is one of my strongest personal beliefs, that you don't hurt or dishonor friends and family when they have done nothing wrong.

Post Note-

Keep in mind I am talking about the ones who are allowing selves to be pawns for money and who, not every parent is like this.
