I do not think the driver should be charged with vehicular homicide. They were all behaving recklessly, as young men sometimes do. They all participated. They all bear equal responsibility.

I agree, but there has to be some form of punishment besides humiliation - I mean only one person was technically responsible for the actions of the vehicle... nobody forced him to push that pedal.

This is very tragic, my best wishes go to his family and friends especially those who had to deal with seeing their friend pass. I hope this makes some of us more aware of the dangers that come with irresponsible driving.

Hadd lessons but in these cases the driver is ultimately responsible for the vehicle and his actions. Young people simlly don't weigh possible consequences for their actions.

All I know is if I were the driver I would have stopped if someone stood up in my 4R. Last thing I need is a pair of flailing legs in my face while trying to do donuts in a gravel pit. Might have even been the reason for the crash. But that's just me.

While I agree with your statement, my state, Virginia makes a point of the responsibility of the driver.

The driver must ensure the passenger is seat-belted, as well as any persons under the age of 16 in the backseats buckled. And anything reckless on any of the passengers' parts is the drivers responsibility. Essentially they say that if a passenger acts out, stop the vehicle and demand cooperation.

My opinion would be that the driver deserves some reprimand, but NOT the charge of vehicular homicide. The reason I believe the driver deserves more is he was driving recklessly. However, he had no intention to murder any of his friends so why hit him with such a charge. I'm sure he already feels devastated that he killed a friend.

Haha, I agree! I've even known a buddy to get a littering ticket because his passenger threw a wrapper from Taco Bell out of the window. My friend didn't even know he did it. It's pathetic, but welcome to the Commonwealth, right?!

A legal 18 year old adult dies because of his own stupid actions. Now if the driver were under the influence, sure I'd understand then. If they family doesn't press charges, nothing is going to come of it. The driver has to deal with this for the rest of his life, that's plenty of punishment in my eyes.

Both were responsible - one already paid the ULTIMATE price. The other will pay an infinitesimally smaller price.
