The argument that anyone should be able to own any firearm "because freedom" is as laughable as it is scary.
The Conventions of a number of the States having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government, will best insure the beneficent ends of its institution- Preamble to the Bill of Rights
The 2nd Ammendment states: A well regulated
Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
We need to define 2 words from the 2nd Ammendment. One being "regulated", and the other being "Militia".
"Regulated" in the Colonial Period would not be the same as what we think of today. When we think of regulation today, we think of Government intervention. "Regulated" during that period: To adjust to some standard or requirement as for amount, degree, etc;To adjust so as to ensure accuracy of operation;To put in good order.
A well regulated Militia didn't mean it was restrained, it meant it was in good working order, with the equipment needed to provide protection for this nation.
Read the Journals of the Continental Congress 1774-1789 for many referenced of "Regulated".
That gets us on to that oh so nasty and taboo word, "
Militia"
According to Title 10 Subtitle A Part I Chapter 13 of US Code
The "Militia" is :
(a)The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b)The classes of the militia are—
(1)the organized militia, which consists of the National Guard and the Naval Militia; and
(2)the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.
That means the vast majority of members on this board are Milita whether they know it or not.
Why shouldn't I as a law abiding citizen be able to purchase and own any firearm my heart desires?
