odometer fraud!

OP, sorry to hear you're dealing with this. Couple quick things:

What does the title say for mileage? Did it say 97K or 206K? Or did it say something about mileage exempt (being over 10 years old in some states will do this) or did it say anything about true mileage unknown? This is really where you're either going to have a leg to stand on or be screwed. If the dealer represented the mileage on the odometer as accurate and backed that up with a title showing those miles as well as an odometer disclosure statement, you'll win this case 8 days/week. But, if they disclosed as mileage exempt or TMU, I think you're out of luck.

I can't speak for Florida, but in PA, if you buy a car, the mileage is disclosed to you as accurate (97K in your case) and you then discover odometer tampering (206K in your case) you go to court. The dealer has to pay you 3 times what you paid for the vehicle AND you get to keep the car. I hope FL has a similar consumer protection law for you. Good luck.

If this was pirate I would tell him to stick body parts in blenders and drink bleach and a myriad of other insulting childish things that go on over there.
 
Have you not contacted the dealer that sold you this vehicle? I find it hard to believe you weren't kicking in the door 5 minutes after learning you got screwed.

If its a Toyota dealer, I would like to think they would rectify the situation. If its Don Juans used cars and ovens, you might have a struggle ahead of you. Either way, I wouldn't settle for anything less than a refund. Good luck!

Wouldn't happen to be Pensacola Honda? I bought a used 4Runner from them and drove back to Louisiana, next day check engine light came on. Freakin Evap Cannister and the ODBII port was DEAD. Next time I buy a used car I will bring my own scanner. Later found suspected evidence of water damage to vehicle when working on electric seats. Check your Folrida "as is" laws, not much I could do. At least I was able to verify my mileage by calling several garages listed on carfax (101K miles).

I don't trust carfax either, Carfax had an accident listed as "vehicle ran off road, no damage reported". 4 days after I purchased the vehicle a new entry was inserted into the Carfax that stated, "vehicle damage report - vehicle towed". Sort of suspicious. Eventually they wore me down and I gave up arguing with the dealer after filing complaints with SOnic Automotive, BBB and the District Attorney.

What happened?

I feel your pain this just happened to me. I bought an 03 from an individual that I was told was the original owner. The car fax did not have a lot of mileage records so I did not think anything about it until I had mechanical problems right away. After further investigating I located the real owner and found that the individual I bought the car from had just purchased it from the real owner 2 weeks prior and that he had turned the mileage back 54,000 miles. The original owner said he did not fill out the title, because that guy told him it would be a surprise for his mother and he wanted her to fill it out..... Basically the guy I purchased it from was a "flipper" and lied about EVERYTHING! Carfax does not always give you all the answers you need. It is a mess and I don't know what to do. What have you done about your situation?
 
i submitted paperwork to the state 2 weeks ago and there is an investigation under way. i also received a letter stating that an in depth investigation is taking place to find previous ownership to verify mileage, repair records, etc. the state police is also involved.

Hope it works out. But back to my earlier questions: what did they put on the title? Odometer disclosure statement?
 
I don't understand why a dealership wouldn't have gotten a carfax on it before they accepted it as a trade-in. I am sure the dealership is gonna plead they too didn't know about it but I would assume all dealerships would want to know the true value of a car before accepting it since they don't know if the darn thing had been totaled before etc.

Hope things work out for you. That sucks because they probably squeezed more money out of you arguing that it had low mileage and that's just not right!
 
3/27/13 the truck was listed as having 206,325, dealer inventory
4/05/15 same dealer inventory
5/20/13 truck has 206,346, sold to or bought from auction
6/03/13 i buy it with 97k+, purchase reported to state on 6/4
took into toyota for trans service at what i believe is 98,853. carfax reports "mileage inconsistency".
either the dealer changed the mileage or someone at or with the auction did it.
