Throttle-by-wire is full-time on ´01-´02. The throttle cable is only a limp home backup, and will only open the butterfly part way. Is that what you are asking?

Well my more elaborate question got deleted and I don't know why..

I got a check in the mail in regards to toyotas 1billion dollar payout about the "malfunction" if you will, of their electronic throttle-control system. I would think SOMEONE on this forum would have received the same letter . I would link you but I think thats why my post got deleted so you should google it . It applies to a lot of models and years so I figured it would be a pretty talked about subject here

01 and 02 4runners are included in the settelement. I don't know how much people are getting, but maybe most are only now becoming aware. Its not a known failure for 3rd Gen 4runners. What IS your question? Or did [MENTION=10169]TheDurk[/MENTION] answer it?
 
Basically in a nutshell I'm asking, if I cash my 30 dollar check and later down the road I kill someone or myself in an related accident, is toyota free of litigation?

Why would they go after Toyota if you killed someone? The $30 dollar check isn't a blank check to kill other people dude, its to fix your car.
 
this unintended acceleration thing toyota was dealing with was not a electronic throttle malfunction on any of their vehicles, there is no documented evidence that supports this, noting nada zip... engineers in labs could not no matter how hard they tired, get the problem to replicate... it was simple a matter of people stacking floor mats or not securing floor mats properly and them moving forward onto the gas peddle. these drive by wire systems have several redundancies built into them -think of it like the safety on a glock or xd, your finger HAS to be on the trigger for the gun to fire... the gas peddle HAS to be pressed down for the car to accelerate. a electronic glitch, or malfunction alone will not do anything if the pedal is not depressed.

take the money and dont be an idiot. its people like you who are whats wrong with this country... always looking to get rich off of someone else or take advantage of some loop hole. on second thought no, dont take the money and just wait for the day that your 4runner just takes off at a crosswalk full of kids or drives itself into the mall on black friday... that check will be your get out of jail free card, that check will be worth way more than the $30 then...:censored:

It has nothing to do with if you cash the check. If you have a duty of care, its regardless of the settlement of the class, or whatever check you have. You know your toyota may have an issue, and that has nothing to do with the cashing of the check.

If you take a part in the class, are a party to it, you cannot seek your own damages. I am assuming you filled out a card to join a class, and by cashing the check, you accept the settlement. If Toyota had a judgement to pay back damages to vehicle owners, then it doesn't matter. Either way, check doesnt matter.

You're probably more likely to be killed by lighting than a run away toyota.

Holy wow. I'm not trying to take advantage of a situation and sue somebody. I bring all this up because one of the few times I used my cruise control I noticed it started accelerating by itself RAPIDLY. As if I had floored the gas pedal so I stopped using it all together. I was trying to confirm if this was the issue being addressed.If by chace it is NOT, I just wanted to know what IS the problem they are talking about before I cash it since the top of the check says
" By my signature on the back of this check, i hereby agree to the terms of the release as stated in section VI of the settlement agreement". That is all plain and simple. Someones having a bad day jesus christ lol
 
I want $30... That would be awesome for a broke joke like me...

I would like to know exactly what to watch out for and what to do if I get into a sketchy situation that this settlement is addressing...

Haven't seen much on this forum about a run-away car:.. Does it only occur in cruise control?... Which I use pretty much every time I go to work?...

I don't feel OP is trying to take advantage.. I think he is trying to gain understanding.

It sounds like in a worst case scenario just shift into neutral and pull over and turn off the ignition?......

Yes. Pop it into neutral and let the motor redline while you get the vehicle stopped as quickly and safely as you can. Probably don't turn it off until you're stopped unless you feel comfortable coming to a stop without power steering or power brakes.

Not that this will ever happen to you. Skynet is not in control of your truck, and it CANNOT accelerate without being told to, by you. It's practically impossible.

I think you picked the wrong "forum" to ask. What you'll find here is dedicated 4runner "enthusiasts" who with little exception LOVE their Toyotas. We are also largely the DIY type who don't believe in Unicorns and other myths.

I don't mean to sound condescending, but your posts have made you sound ignorant of the facts. That and the fact you have very few posts make it seem like you came here looking for an angle to something. I am not accusing you of that, just telling you how it appears.
I for one have never believed ANY Toyota actually failed in the way they described in the media. I do believe some throttles got stuck, but not because they were defective electronically. I think the Camry pedal design lent itself to the "floormat" issue, but only that model. If you think you are leaving yourself open to litigation, or denying yourself a bigger settlement, don't cash the check. It's 30 bucks, hardly worth losing sleep over.

I have little posts but I came here 5 years ago lol. I love my 4runner its my life I just wanted more info on this settlement so I knew what was going on, as stated above. I figured seeing as it was a huge payout that people here would have received the same letter I did. However, just like everywhere you go you got people clueless to the subject adding their two cents when they have no idea what they're talking about.

Bottom line- not trying to get more money just seeing if its safe to cash this 30 bucks in lol
 
ok sorry for jumping down your neck like that, but i hope you can see how it looked like you could of potentially been out for a payday...

in answer to your question, yeah i think you need to contact a legal representative ie attorney to get your answer. you will get who spectrum of answers here(as you have seen) -but if i was you id cash the check and go put gas in my rig. i can think of any of these socall cases where it was a 4runner that it happened to.
